Whenever the idea of instituting affirmative consent is brought up, many (myself included) scoff at the idea. This is for several reasons, but the one I want to discuss today is implementation. So, for this discussion, let's put aside questions of mood killing and other concerns and focus just on how it would work mechanically.

The most extreme concept for affirmative consent is signed consent contracts. Most people here (quite reasonably) agree that this is an extremist approach, and has little to no viability in becoming a common practice.

The problem is, contracts are the only way affirmative consent laws could have any chance of efficacy in proving consent without opening up a myriad of other issues.

Photo together? People take pictures together without f#cking all the time.

Dirty photo together? Should people really have to risk revenge porn to prove they didn't commit rape?

Verbal affirmative consent? Then we're just back to a he said/she said situation.

So, proponents of affirmative consent laws, how do you plan to implement them so they are effective?

PS, I'm tagging this as a discussion because I want to hear from B/P/Rs all alike, but fellow RPers, please don't waste my time and yours by responding "They don't."
