This is the real story here. The cops didn't discriminate against the guy, and actually upheld the law despite the genders being reversed. This is a win for equality and men's rights!

Of course that part won't be reported in the media, just like the first 20s of the video where she kicks him in the gut (looks like she was going for his nuts) and hits him multiple times.

While the video is upsetting and difficult to watch...

The only thing upsetting about this video is all the white knights jumping in and all the "dude, you can't do that! What's wrong with you?" only after he tackles her, but they're all standing back watching, perfectly chill when she was attacking him

Yes.

In the case of Ray Rice I think the main issue was that he was just so much stronger than her that he did a lot of damage, but there is really no question that she was the primary aggressor. It's amazing to me how uncomfortable we are as a society about this issue. If you're attacking someone, they have every right to use reasonable force to defend themselves. We need to have stronger stomachs and realize that the victim isn't the one who lost the fight.

If it had been a guy attacking Ray Rice, even if the guy was only 120 lbs sopping wet, it would be the attacker on trial. I support responsibility for your actions. Even if you have tits.

There might be an argument that Ray used excessive force - but with one punch, I doubt it. However, the woman was not charged.

This is the part about this subject that shits me the most. When there is a woman instigating the violence, even if you can get somebody to concede that physical retaliation from the man isn't entirely unjustified, you will nearly always hit the wall of "well, men are stronger and need to show restraint when dealing with a woman".

I mean, maybe that's true but I'm not exactly a paragon of male physical strength but if I started shit with some tank gym rat and he punched my lights out for me, I guarantee you nobody would be wringing their hands and telling that dude he should have been more restrained with me because I'm weaker. They'd be (rightly) telling me I was fuckwit for starting trouble with a guy who was obviously going to kick my arse.

For his own safety he should have asked if someone could move her away from him first. Self defense or not, he's a man and because of that he won't get any sympathy in court. I think the guy near the end of the video said it best:

It was a snap second decision, all with adrenaline and an angry fucking woman coming at him. It's impossible to make a call there that would end up with everyone happy.
In addition, if you took out the gender roles from this completely, it would just be another fight.

Nah man, keep it in perspective. He has the right to defend himself, but as soon as the attacker is incapacitated he is obliged to stop. You can't just kill someone for trying to slap you and say it's self-defence.

IMO the amount of force used was perfect, with her unable to attack him further (The other girls still try it, though).

because the threat is neutralized and from that point on it is no longer self defense. Same rules apply for shooting criminals that break into your house. You can neutralize the threat, but executing them after they are no longer a threat is murder.

Because self-defense is only valid as long as you are defending yourself. If your attacker is incapacitated and you have reason to believe they will stay incapacitated, for any further attacks you are the aggressor.

Aaaand of course he's the villain, because reasons. If you attack someone, expect to face resistance. And if you can't handle the heat, get out of the goddamn kitchen. That bitch got what she deserved. He's the bad guy, yeah right. Because 3 against one is so fucking unfair for the women, how did he even dare. Fucking cowards. Abusing their power, because they know damn well that THEY are not going to be held responsible AND outnumbering him. And even though he seems fairly skinny, he would have crushed them, had they really pissed him off and made him completely lose his temper. It's his inhibitions that gave them the huge advantage. A guy wouldn't have gotten of so cheaply. Personally I would have prefered if he had done some damage, because frankly, he had every right to do so after being atttacked by them, but he did the right thing. He wouldn't be able to show his face in public if he had really hurt them.

It is understandable why the people the showed up thought he was the villain. You see a bunch of people yelling at a someone for attacking another, you see the former collapsed on the ground and the latter not in apparent harm the assumption does tend to be that the person in clear harm is the wronged.

Resistance

I don't need to throw a headlock to defend from an attempt at a slap. It's upsetting seeing people condone such a harsh over-reaction. She was hospitalized, while he did not walk away with a single scuff. He could have easily solved the problem with a shove, a punch, a leg sweep, and I'm sure she would have let up. He instead decided to get into position, and hip toss her onto the concrete.

That bitch got what she deserved...

I think that even if you don't start a fight, it is immoral to respond with extreme force. I will cite several examples that I took from a great article I read that I can't seem to find.

  1. Your son is being harassed at school by a bully, but it is purely verbal. Your son decides to fight back by pushing the bully onto the ground. Would you call your son a bitch who deserved it if the bully bashed in his head with a rock?

  2. You just had an affair on your wife of 11 years. In a fit of rage and passion, she tearfully slaps you on the face. It leaves a red mark. Can you then respond by shooting her in the face?

  3. A homeless man, appearing to be mentally disabled and unmedicated, sticks out his foot to trip you. Can you respond by slamming his head on the concrete repeatedly?

It is clear that the attacker was stressed, and reacted extremely poorly and stupidly. But she did nothing to deserve a concussion, which is a seriously underestimated form of trauma. Self defense is considered acting in such a way to overcome your assailant to defend yourself. This was clearly not the most effective way of countering the attack - A trip, a shove, a tackle onto the grass, all would have been less permanent injuries.

A guy wouldn't have gotten off so cheaply.

It's not about guy or girl. It's about the threat posed by the attack and the necessity to respond with extreme violence. The average girl is significantly smaller than the average guy, and most guys that are so small and weak as the assailant would never have the confidence to attack someone so much bigger - sure the woman was INSANE in her attack, and she is totally at fault for the start of the fight, but the guy over-reacted.

Edit: I am surprised to see so many down votes on this sub. Of all the subs I frequently this one I remember being the most willing to have pleasant discourse. I hope I didn't offend anybody, I was just pointing something out! I do agree with most of the responses to my comment however.

I saw the original video that lead to the altercation. Here are some facts:

A) She came on to his property with a couple of her male friends to start a fight because he called her a bitch and a cunt.

B) He demanded she leave multiple times.

C) She came at him with her hands out as her first mode of attack.

D) He put both hands up, forward and open palmed to block her.

E) She kicked him in the gut in response then relentlessly continued rapping on his stomach.

F) He hip tossed her and cushioned the back of her head with his arm so as to shield it from serious impact and avoid giving her a concussion.

G) She has a history of seizure activity so of course her body is going to respond to being put down like that.

Now, I don't want to hear anymore about "Size Difference" or ridiculous hypotheticals to justify a woman using violence as a means to resolve a conflict. This girl went on the offense and was really lucky he took her well-being into consideration when performing that hip toss. Any other man and they would've broken her jaw with a left-hook or cracked her head open on the pavement.

If women are significantly smaller than the average guy then its all the better for them to learn not to resort to violence against a bigger man when they're angry and the man never hit first.

She attacked him remember. He defended himself, neutralized the threat then left. He didn't continue to attack. He got up and walked away.

That's what I've been trying to say this whole debate.

NOBODY has the right to assault someone over name calling. Man or woman. This girl should've dealt with it in an alternative matter. But she refused and he had to act fast lest he be the one being carried by gurney to an ambulance.

I grow tired of people's implicit call to bend a rule all of us were taught while we were in training pants because a girl got called names. Anyone still wishes to find exceptions in situations like this, go ahead. I refuse to endorse. End of discussion.

Fighting words would not invalidate the girl's responsibility for assault, just the self defense that protects the boy's actions. The full video shows that the girl traveled between the words being uttered and the fight, so the fighting words doctrine doesn't actually apply in this case (and my post has been edited to reflect this).

I don't care if the words were screamed in person or by phone. This boy didn't raise a hand, throw a jab, or did anything physical first before the altercation escalated except demand that she leave. Which is perfectly justifiable since she was trespassing on his property and brought back-up along the way (turning this into a gang against one).

1) Fighting words doctrine has nothing to do with the girls response to those words. Even under that doctrine, she remains entirely guilty of assault.

2) Fighting words doctrine is a legal doctrine and has nothing to do with my judgment of what someone deserves.

All that fighting words doctrine means is that you cannot invoke self defense as a legal defense if you verbally incited the violence you are defending against. For a court to judge that one's words were incitement, the violence must be an immediate reaction to those words and the words must be considered to be provocative under the reasonable person standard.


In other words, we are not in disagreement with each other, you are in disagreement with the existing jurisprudence in America.

See the edit. It turns out that, in this case, the potential fighting words were delivered over the phone, after which the girl had to travel to the boy's home before the fight began. The lack of immediacy means the words fall outside the scope of the fighting words doctrine.

Your resistance scenario is based on the assumption that you are/will be only slapped, which you have no way of knowing. It is both reasonable to not want to be struck, and to resist being struck again.

  1. It's the wrong question, and an appeal to emotion disguised as logic. The son escalated.
  2. Reverse the genders and ask yourself this question. Would you still excuse it as "tearful passion"? Why not?
  3. How do you possibly know the medical status and history of a homeless man you are passing on the street?

There is no limitation on the legal definition of murder based on the size of either the murderer or the victim. Size should no more be a distinction than gender. To advocate otherwise is inherently sexist, and bizarre.

You seem to be making a "just war" defense. But these examples are not particularly strong. You are making appeals to emotion and loading the deck. (Why "little bitch" and not simply "wrong"?) You assume that a specific hypothetical has universal application, or that any scenario offered resembles the one actually being discussed. And you ignore potentially unethical ramifications from your own argument.

Exactly! She was out of control and unpredictable. Next thing you know she could have kicked his balls and SHE could be the one smashing HIS head on the floor repeatedly. I'll tell you a little story about a boy who was hit by his parents, especially by his mother, over trivial things. He was a quiet guy, not your typical mischief-maker who was hard to handle and overtaxed his parents. He never got any bruises, but being metaphorically or literally backed into a corner and then hit was terrifying. He was a weak child, too, so the best he could do was dodge the hits and hope it would end. And one day, he couldn't have been older than 14 or 15, he snapped and he hit back. One single punch on his mother's arm that resulted in a bruise with a diameter of probably 10cm.

You think I planned that to happen? I was shocked when I saw the bruise, cause I didn't think I used that much force, but there I was. Still, no matter how much I think about it, I can't bring myself to really regret it. From that point on my mother never laid hands on me again. The verbal abuse didn't stop, but at least the physical did. And do you think he was battling girls all the time so he could perfectly estimate the impact he would have on her? No. He miscalculated his own strength and the force she could take. He handled the situation as good as he could have considering the situation. He didn't continue excessively hitting her when she was already lying on the ground, he just put himself out of harms way. Nobody should be shamed for defending themselves.

And to your "examples": The situations were all pretty predictable, the victim of the "minor assault" wasn't in any great danger, so the use of violence was by the aggressors, i.e. the bully and me, were excessive (for clarification: the victim of the minor assault and the aggressor are the same person). Same is not true here. Like I said, that bitch was unpredictable.

But sure enough I'd ask my son why he pushed him. As long as you're not under attack or in danger to be attacked, I don't think you should make a verbal argument physical for that exact reason. You can scream at each other and call each other names as long as you want, but the shit hits the fan once punches are thrown. You can't rely on others to be gentle to you if you start the physical confrontation, so better don't start it in the first place. We can cry how unfair the other person was being, but ultimately it's our face who was smashed into the floor and no whining in the world will change that. Better safe than sorry.

Exactly! I think people who say "that's to much force" either for police, or when someone is defending themselves have never been attacked, or stopped a fight. I have thrown a fairly large male several feet who hit a wall a couple feet in the air. I didn't mean to throw him that far, but he was the aggressor in the fight and wouldn't stop. My adrenaline was so high I felt like I was throwing only a few pounds, and he was 200+ lbs if he was a ounce. Once he left my hands and was flying in the air it was one of those "oh shit" moments. Those moments seem to go at lightning speed, something that seems to be seconds in a video will be perceived as milliseconds while under the fight or flight reflex.

I once saw myself on video breaking up a fight, the one were the male was thrown I mentioned earlier, and I thought I was watching it in slow motion. It seemed to takes ages, while in my mind it was soooo fast.

Could he have dealt with it better? Sure nobody is perfect and the person at fault is the one who started the violence.

Are you talking about the gazebo shooting? I agree if the person had a hostage or something then that's a bit different. But someone alone and not really in much position to harm anyone but themselves or property is something that should cause a slower more careful approach.

But in the case of the guy stealing a soda and approaching cops with a knife in hand and was shot was a case that was needed. Innocent people were just feet away, and FBI studies show a person with a knife is as likely to kill you if under 30 feet away as you are of being able to pull your gun and fire to protect yourself. But people got upset he died, it just amazed me as it's obvious he was wanting to get shot and the police had basically no choice because of innocent citizens just feet away.

Another people got mad about was the guy in a wheelchair who was trying to have his gf sneak him drugs and he got put in a choke hold (the video starts to soon before the choke hold do is unknown if the guard have orders for him to spot it out. I don't know much about choke holds as it was illegal in my state, but I've heard it being used in exactly the way it was there to stop someone from swallowing drugs.

But in the video op posted the man simply defended himself and if it had been another man I would have laughed and called it just desserts. While I would have approached it differently if I had time to think about it like maybe just going inside, grabbing the girls wrists, or pushing her away I won't call it to much force what he did due to a variety of reasons.

  1. She came to his property
  2. She closed the distance between them
  3. She initiated the violence
  4. She continued the violence after he reacted defensively
  5. He stopped aggression once he no longer was being attacked

From the short vid on the link OP provided, that was my initial reaction too. Yes, she was being an obnoxious, aggressive bitch; yes, she was in his face; yes, she escalated. But his actions exceeded what was necessary to stop her.

That said, everyone here - me included - are making judgements and saying "she should have this..." and "he should have that..." and whatnot, all with the benefit of videos and plenty of time to consider things. When you're on the spot and in the thick of it, however, you don't have all that much time to consider, especially when you're young and/or there's drink and drugs and so on involved.

I hope both of them learned something from this.

proportional is no the term the law defines. it states that the defense should not be excessive. eg; proceeding to beat her face in cuz she was charging at him swinging. He could have brought her to the ground gently and pinned, but the head lock gives only a temporary control to the situation unless the one placing the lock is significantly heavier than the one locked. Most people will respect the head lock as their loss and yield to it. The girl continues struggling, trying to throw the boy off balance.

Every act of violence has risks, you can kill someone with just a punch if you do it "right". Which is why you get to defend yourself in the first place, because being attacked puts you at risk. Just being hit in the side of the head has the potential to cause you to go deaf in that ear, you can be shoved and hit your head and die. Context is everything. Yeah, you can treat every altercation like a life or death situation. It makes sense from a certain perspective. I mean, sometimes in a fight you gotta do what you gotta do - but there is also such a thing as context, and not every altercation should be treated like a fight to the death. And when you have a huge advantage is size and training, you also have more options. When you're not in much danger, it's normal to expect a proportional response.

It's entirely relevant - in both cases people were legally in the right to do what they did, but the level of force used was silly disproportionate for the situation and drew censure. Those kinds of takedowns are among the most damaging moves you can do to someone, and should be reserved for life or death situations or the gym - when you answer an attempted slap from a massively inferior opponent with something that's starting to approach deadly force, that's the very definition of disproportionate.

I've been slammed onto concrete before (went off the edge of the mats in a multi use gym with concrete floors), and it does indeed hurt like a bitch. However, it looks as if he kept her head from contacting the ground, so the impact probably knocked the wind out of her and bruised her up, but that all heals. "A quick jab", as you suggest he should have done, could have knocked her down and had her head bounce off the ground. People have died from single punches like that.

After reading the article I'm inclined to agree, but this is an absolute warning to people who ever find themselves facing off against anyone, not just a girl on concrete or any other kind of hard surface from somebody who has had training.

Don't ever, ever use throws if you can help it and be very careful if you decide to do anything else, if you don't watch yourself, they can smack the backs of their heads on the concrete and end up getting killed or disabled for life, or alternatively they could end up smacking their spine and that will disable them permanently as well and this alone could land you with some serious jail time. Don't listen to any trigger happy or tough guy retards on this subreddit who tell you it's okay to go around beating the shit out of anybody or shoot them because that's a fast way to get you into trouble.

This is why police officers always use stuff like grips to hold down somebody aggressive, use cuffs, or tasers and pepper spray. It sounds ridiculous, but getting them to roll around on the floor for a bit and scream is a much better option for them than end up getting hit with a massive lawsuit because they were resisting and wouldn't go down or leave of their own free will.

This is a really common misconception - This idea that with martial arts training you can subdue attackers and "nobody gets hurt" - it's wrong and has no basis in reality. Anybody that does that and it works was just absurdly lucky. Most of the time you try that and you just end up way worse off. You are trying not to hurt the other person and they don't have the same restraint at all or you wouldn't be in the situation in the first place

I didn't say don't hurt them. I said there are better ways. His method was rather dangerous as it risks head, neck and spine injuries. It wasn't unreasonable as I said, it's instinctual.

A "non-violent" take-down like a hip throw can do a lot more damage than a strike when you're not on a dojo with padding on the floors.

Agreed. You can practise throws like this in a dojo with a minor risk of harm to your partner, not just because of rubber mats on the floor but also because you/ your partner is expecting to be thrown. They weren't in a dojo, and she wasn't expecting it. That crash-landing on concrete could have much, much worse.

Nah. She put her hands on him. When that didn't work, she tried kicking him. What would she have tried next if he didn't stop her? How many chances should you give someone to hurt you before you end it? How long was he supposed to dance with her before her girlfriends or one of the other guys sucker punched him? Fuck that. The situation was clearly escalating. I don't blame him one bit.

He didn't. She was out of control, punching around all over the place and a potential danger. He did what was necessary to restrain her. Was there another way to handle the situation? There probably was. But you can't expect him to come up with the best way possible to handle the issue in the heat of the moment. His reaction was fair game too.
