Common sense isn't a trait that prevails on the internet. Crazy people gonna outrage and make outrageous statements, in years before the internet all they did was scream at an empty room or a street corner where people laughed and pitied them. Now you can instantly put your looniest notion in front of thousands, and even if a few of them think "YEAH, HE/SHE'S RIGHT!", they share with their friends, which has the potential to blow up into this. Sue for court costs and $1, with a pledge that if you win you'll donate $1000 of your own personal money to charity. Sure it'll cost you $1000 if you win, but your costs will be covered and there's absolutely no way anyone could pretend you were suing for the money. So then they'll pay attention to your point.

Wow. This hits home. I dated a woman one time who would rip me a new asshole right in front of her little kids, screaming every f-bomb and swear word at me in her limited repertoire, but if I raised my voice and sweared back at her, she would chastise me for using foul language in front of her kids and yelling at her, which "wasn't kind". Yeah, she had some mental health issues.

my mom did this all the time with my dad... he would wait till i was gone but she would tear in to him with me there, or tell me everything wrong with him when he wasnt around and branch in to what was wrong with men in general.

Of course later she would go off on me for random shit when she had a hard day too, then vent shit like how her boobs have never been the same since she had me.

There's no such thing in a Libel case. It doesn't matter why you wrote what you write, so long as:

  1. You wrote it.
  2. The statement is false.
  3. It claims to be a fact, rather than an opinion.

Proof of malicious intent is needed in order to claim damage to reputation. It doesn't seem like the woman acted with malicious intent, but the subsequent publishing of his picture on social media without verification of any wrongdoing could be construed as such. It could be argued that removing the children from the area and going to security/police was all that was necessary - Going further by publishing the photo may be seen as a malicious action.

However, regardless of any malicious intent (or lack there-of), it is not necessary to prove intent if the victim (the man) can prove actual loss or damages (turned down for a job, lost business, etc...) caused by this statement.

I'm a lawyer, but not your lawyer. Laws vary by jurisdiction. This is purely information, and not an opinion on a case.

I just want to point out that "Acting with Malice" is a legal term of art, and basically just means that the person knew it was false, but said it anyway. This is a little different than what the average person thinks it means when you say "malicious intent".

  1. Implication that the victim is a child molester. It's a clear labeling as shown by numerous, supposedly reasonable, people believing as such from her post - Enough so that it made the news.

  2. Damages could be proven based on what happens. I'm not saying there are or are not damages, I don't know what is happening in this man's life. You could also prove malicious intent and then won't need to prove specific damage other than to reputation - As I said before.

  3. Legal costs in these situations tend to be included in the lawsuit. As this has made international news, I'm sure there's a lawyer in Australia that would happily take the case. From my understanding, and I may be wrong or misinformed, Australian defamation laws are much stricter than American laws. This may prove for an easier case. Again, I am not as familiar with Australian laws.

This is not an easy case and damages would be difficult to prove... not to mention you'd struggle to find a sympathetic jury AND you have no idea if you'll be able to collect a judgment (if you win) from the defendant.

This is actually a surprisingly easy case.

  1. We know the woman wrote the statement.
  2. We know the statement to be false.
  3. The statement is stated as fact rather than opinion.
  4. The woman was no longer acting in the interest of her children in writing the statement. Protecting her children was complete upon notifying the police. Any further action taken afterwards, outside of police or security investigation and particularly BEFORE police investigation can be complete, is with malice towards the victim. Perhaps she believed the malice to be justified, but that does not change the nature of her intent.

Everything you need for a defamation lawsuit is available. You won't even need to prove damages outside of reputation because the woman should not have been posting to social media before the police could complete their investigation.

Now, had the woman merely mentioned that this occurred without stalking the man for a photograph (and she left her kids with security to do it, which isn't really what a protective mother would do) and posting said photograph online with the clear implication that he was a predator, then she'd be fine. She would be fine if she merely said:

"Had a scary situation at the mall today involving a man taking a picture of my kids. Police are investigating. Parents, please protect your children."

There's no explicit, "This man is evil!! EVIL!!!!" Yet, she made a very clear point to make sure his face was online and a clear implication of him being a child predator. That was done purposefully and clearly shows intent.

This would be a fairly simple case in America. As it's in Australia, where I'm led to believe laws are stricter, it becomes even easier.

Also, a few points:

  1. While you may not be able to collect from the defendant, you would not be responsible for legal fees if they fail to pay.
  2. This is libel, not slander.

I would be interested. I've had this idea in the past and I would jump on board if someone take the lead with it. I myself am happy to set up a recurring $10/month charge, so long as the fund is administered through voting. Meaning that I'll put my money up as long as when and for whom the fund is used, is decided through reddit-style voting.

We could even use a subreddit just for that. For a particular disbursement cycle, there could be a comment thread. Each top-level comment would a proposal for whom or which case to fund. Comment replies could debate this, then votes on top-level comments could determine the disbursement.

I've seen some other interest in this sort of thing from other people, as well.

I certainly hope so. And i would like to point out that in Aus, it is much easier to sue someone for defamation than in, for example, the US. A couple of years ago some woman successfully sued a comedian for joking that she was having an affair with one of the football players her husband coached. I think there is also a precedent for going after the people who shared the post, without whom the accusation would have meant very little.

I'm not sure how it is in Australia, but registered sex offenders that are child predators or with related charges, are not allowed within certain distances of schools. It's not ruled that they "can't be near children", because children are everywhere - and the offender has to get groceries and shop like everyone else.

Certain sex offenses probably prohibit them from using a recording device on a child, though. But that doesn't apply to all sex offenders. As everyone on this sub is aware, people are put on the registry for urinating in public, or having a slightly younger girlfriend in high school - among other things.

It is a strange comment by the police either way.

In America (I think most of the states) you can't live or frequent anywhere that children are known to congregate. So parks, schools, playgrounds, etc. But this is a store so even if he WAS a registered sex offender it'd be fine so long as he wasn't actively engaging with children. Yes, it is. Criminal law - including "wiretap" laws - vary from state to state. Pennsylvania requires prior consent from all parties before you can record their conversations.

Pennsylvania Wiretap Law - despite the name, it covers "recording oral conversations" which means videotaping, too.

I really don't think you understand how a federal system works. Hint: Individual states can grant their citizens more protection than federal laws do.

You claimed that the only law governing recordings is federal law. I've given you a clear and irrefutable fact: Pennsylvania has it's own laws governing recordings. When you're watching someone do something crazy, sometimes all you can think is "what else woulf this person do? I have no idea how deep this crazy goes" and avoid a confrontation. He should not have given police permission to search through his phone. It doesn't matter that he had nothing to hide; the unfounded accusations of that woman did not constitute probable cause and he should have stood up for himself.

Consider if he had accidentally committed a crime, something unrelated to paedophillia, and there was evidence on his phone. Or just that there was evidence on his phone that made it look like he had committed a crime. It's always possible unless you are a lawyer and actually know your country's entire legal code. He could have accidentally incriminated himself and been charged.

This is a fairly unlikely scenario, but it's the principle of the thing. The reason police have to get warrants in countries like Australia is because it was decided a long time ago we have a right to privacy which shouldn't be violated unless absolutely necessary. Voluntarily surrendering this right is not under any circumstances a beneficial decision for yourself.
