CNN: Should false rape accusers be sued?

I think it's important to make a distinction here. If a defendant is found not guilty of rape, that doesn't necessarily make the accuser a criminal. However, of evidence is found that the accuser may have intentionally made a false accusation, then they should definitely be charged and go to trial.

Does that make sense? It's an important difference.

Edit: there's also an important difference between charged and convicted.

There is a difference between the Winston case and a false rape accuser. The difference being that we can't prove that the girl intentially falsely accuse Winston of rape. If you can prove it, then yes you should sue.

He also said it could "discourage too many from reporting real rapes."

This just pisses me off everytime I hear it. We all know why it doesn't make sense and that it's wrong, but it still pisses me off.

Can everyone here please acknowledge (which the article fails to do) that there is a difference between purposefully, falsely, and maliciously accusing someone of a crime and false conviction based on misidentification?

See, in the first example, the victim was never a victim. In the second, the victim was still raped and murdered, but just by a different person than the one who got convicted for it. In the first instance, yes the accuser should be punished/sued. In the second, the state should be punished/sued. Does that make sense?

Agreed. But the same burden of proof must be used to establish the false accusation as was used to establish the innocence (not guilty) of the accused originally. Merely finding the man not guilty of rape is not enough to establish a false accusation.

Before anything else, the accused identity NEEDS to be confidential until a verdict is given and no further appeal is made.

This prevents your life from being destroyed by a false accusation. Once that's in place... I'd say criminal charges over using the accuser.

Plausibly but I'd say only if it can be shown that the accusation was....

1) False, as in no rape occurred. Occasionally false identifications also happen.

2) Malice, the person deliberately targeted that person being accused.

Of course I also maintain the accused should have their identity guarded closely.

They should face the same incarceration time as the innocent person they are working to ruin. It's not right and our judicial system is an embarrassment.

Positive reinforcement, negative reinforcement or punishment are how you change behaviors. You get a ticket for riding solo in the carpool you think twice the next time. These women face no consequences on a criminal level, where is the incentive for it to stop?

I'm sorry this hits home for me. Any policy maker that has taken a psychology class should know better.

False rape accusers should be sued for any and all damage(s) they may have caused. In the same way that a rapist should be sued for any and all damage(s) they may have caused, or murder, etc...

I don't know about sued but at the very least it should be taken just as seriously as the rape claim that was made against the accused. Its kinda messed up when a man is falsely accused and everyone is all over it like Batman but when it turns out the claim may have been false the tumbleweeds come in.

If the person doing the accusing is doing so knowingly then yes the person being accused should sue them for defamation/slander, and whatever else they can sue for. The biggest part is that someone can falsely accuse someone by being confused about the situation, such as the person being accused "looks" like the person that committed the crime. It's hard to say but if you put yourself in the "accused" persons shoes... their life was just destroyed by an accusation that was false. The accused rapist will always be an "accused rapist". How many people after hearing devastating news on the television actually follow through and see what happens when the media no longer covers it?

I have been here a while and haven't seen this topic discussed at all. I have seen the MRM advocate that we stick to the basics and require actual evidence when proscueting rapes. I've seen the MRM push for identity-sheilding laws for victim and accused. I've seen the MRM demand the laws be applied equally instead of favouring women. And, finally, I have seen the MRM push for an equitable definition of rape that doesn't write off almost every single male victim of rape ever.

Haven't seen the MRM push to immediately arrest and throw in prison any woman who makes an accusation which isn't followed by a conviction. That is projection. That's one-side projecting their wishes, their desires and their political action on to us. Women want men thrown in jail the second they point their finger. So lets just be honest and address their real concern.

If someone defames you in any way and you have the resources to sue, and are able to make a case under your local laws, you have a moral obligation to sue.

There are serious financial implications to a false accuser. Lost wages, legal fees, lawyers fees, ruined credit and so on. I feel that if it comes out that you were falsely accused and convicted the other person should serve the sentence you were given. Then you should be entitled to damages from the courts.

False accusations are a punishable offense by law; If you accuse somebody of a crime/offense and it happens to be an innocent person, you'll pay.

Why in those cases of false rape accusers nobody is declared guilty of a false accusation? Even in cases where innocent people are charged with sexual assaults jailed while awaiting trial, for example.

I tried to sue my false accuser, but I couldn't get the case on the docket. After three attempts, I was "warned" to let it go or else, I might be found "guilty" of something else. The fact that civil courts are even considering hearing these cases says a lot about the times.

I say yes; if the false accuser can be shown to have done it out of either convenience or malice, then the victim of the false accusation should be able to sue if for no other reason than to have his name cleared. In addition, he's going to need money to sue the jurisdiction in which he was charged to get a declaration of innocence because most jurisdictions will only just find him "not guilty" which is not the same thing. Any man who has ever been falsely charged and ended up in court, should insist on a declaration of innocence from wherever he was charged.

If you are falsely accused, you are going to have to fix your life and she damn well can pay the cost for the whole thing.

Love seeing these pieces from women, there's been a lot of these lately. There was that piece from reason about universities policies on sexual assault, that piece about depression/suicide in young men from time. All three by women.

I like to see these positions coming from women because when we advocate for them and can point to articles like this, written by women, that bullshit about MRAs (I consider myself an egalitarian who mostly approves of MR and is anti-feminist) hating women can just be slapped to the ground.

They should be sued in civil court, but criminal charges should apply as well. Defamation is a serious issue.
