Admittedly, she's not unattractive. I would want to know more about this case before completely writing off on this woman, especially the 17 year old's part in this. He had to have played along with this woman to some small degree if he had gotten as far as going on a date with her, so he may share some small part of the blame for what happened. Nonetheless this woman's actions are irresponsible and inexcusable to say the least. She's a public figure in a position of authority and she brazenly abused that authority here.

This troubles me. I think it's unfair to ignore the huge POWER differential between a teacher and a student. Here, you're framing it like the student was trying to seduce the teacher, which reinforces the idea that women are passive recipients of sexual attention.
Obviously you don't think that's the case, because it's clear that this woman had power over her student and abused it. I'm not disagreeing with your thoughts so much as the wording.
As a woman who was raped at 19 by an older male acquaintance, I've heard a lot of this bullshit about how the younger person must have "played along" in order for things to have gone 'so far.' I know I was incredibly naive at 19, and even more so at 17.
Yes, men and women are socialized differently with respect to sex. Maybe the kid was trying to seduce his teacher. Nonetheless, it's so frustrating and tragic to hear people say that "it couldn't have happened unless it was consensual to some degree." We do not know. Listen to the disempowered party first, always; if a person says they were raped, you take them fucking seriously. I do not know whether the student said he was raped or assaulted or coerced. The only info I can find is saying "all evidence points to this being consensual."

There are other power dynamics at play here than "older person [in an authority role], younger person." I can understand why the judge would be hesitant to order jail time on top of the probation and fines.

Welcome to the patriarchy. Even you can't fathom a woman raping or manipulating someone into sex. If the roles were reversed, a male teacher would be in jail. You know that's true and you know you would support it. And that fact should make you a little bit sad. You can't even sympathize with a victim solely because he's a male.
Men can be raped by women. They can be manipulated and twisted into doing things they would never do otherwise. It happens all the time. There is literally no way the teacher-student power dynamic was not at play here. If for no other reason than the student thinking that it made him cool to be dating a teacher, and a hot one at that.
She manipulated an unhealthy power dynamic in her favor. If she's not a rapist, she's still a horrible person.

Are you saying I can't or don't sympathize with the male student in the case? I'm pretty sure I mentioned my personal history, and that was meant to illustrate my main point: I am deeply sympathetic. I insist on taking victims seriously and hearing them out. Where there's a power differential, it's reasonable to look first at the person who stands "uphill."
One result of the patriarchy is that a man's word is often taken over a woman's; female rape victims are often doubted and called liars, especially when the accused is somebody authoritative or important (see Roman Polanski case, Julian Assange case, every girl and boy who's ever been victimized by a high school sports star).
I feel like you're saying the same thing I'm saying, but for some reason you're annoyed by what I said. I hope I'm getting you.
I can fathom any person manipulating someone they're supposed to care for. People are shitty, and women are a subset of people.
I worry that this kind of situation is going to be used as an excuse to forget that "women in general" are in a particular position in this patriarchy. But perhaps I'm remiss to bring this up here; it does smack of oppression olympics for me to change the subject from this particular victim to the victimization of a separate group he's not part of.

And that should change. But so many so-called Men's Rights activists are too spineless to be consistent with this issue because they know it would come with a lot of pedo-hysterical crap. So instead of championing Men's Rights they instead attempt to undermine Women's Rights by arguing that the woman should be punished for having a consensual relationship with another human being.
I think we need to distinguish between two things here: 1) "punished for having a consensual relationship with another human being" as you would say, and 2) punished for having a consensual relationship with another human being with which you have a prior relationship that gives you power over the other person and may be held to undermine the consensual nature of that relationship.
It's entirely possible to have differing opinions on these two issues. And it is not undermining women's rights should the belief hold that it is not a right for either sex in one or both of these cases (in which case, women getting away with it is a privilege rather than a right).

I didn't say that I think it does undermine the consensual nature of that relationship, just that it "may be held" to do so, which can result in the two scenarios being distinguished and held to different standards. I bring this up to point out that people may object to this scenario for reasons other than being "too spineless to be consistent with this issue because they know it would come with a lot of pedo-hysterical crap" as you stated in your original post, not to say that I take a particular position on the issue (which I didn't in my comment).
Nor am I saying that the woman's rights aren't being undermined in this scenario, but that this seems to depend more on viewpoint as to whether or not the woman has the right to commit the acts she did in the first place. I also took no position on this issue in my comment above.

Sorry, I probably should have worded it better, but I didn't state that he went on the date with the idea of actively seducing her in mind, but rather to see what he could get out of it. He's 17 years old, so he's hardly an innocent child and I think he'd have been able to recognise the connotations of the situation.
Again, I'd like to know more about this situation, including the previous history of the teacher and the student. Were they particularly close before this happened? Did they have a flirty relationship beforehand? What was the actual context of this date? Had she invited him out under the context of help with studying or something along those lines or was it made perfectly clear it was a date from the outset?

17 year olds can legally consent to sex in over half of the US (I think it's about 3/4), not to mention a lot of other first-world countries.
Consensual sex from a 17 year old is not tantamount to rape. It may be a problem in some contexts, especially things with teachers, but on its own, no.
If they are actually raped, then no, but Maxted's comment wasn't talking about that.

It's not simply about age. In many places the AoC is 16 or even lower. But there are provisions that restrict the AoC laws to people who are not affected by a social power imbalance. Even among adults this is the case as evidenced by policies and laws concerning sexual harassment of employees by their superiors. The point is that had she not been a teacher, there would likely not have been an issue. But because she had a social advantage. that being she was in a position of authority and power, his ability to make a reasoned, informed, and most importantly, a free choice was unduly affected.

It is the age of the victim combined with the fact that the perpetrator was in a position of power and authority. She had the authority over him and she abused it to get what she wanted. whether or not he wanted it too is irrelevant to the fact that her position automatically obliges her by law to be responsible for the outcome.

Exactly. A teacher is in a position of trust and authority. I can't make it any clearer than this. Whether he had the capacity to understand what he was doing is irrelevant as well. The basic facts are that he is/was not a legal adult and was therefore legally incapable of consenting to sex with his teacher precisely because of her position as an authority figure over him. Legally speaking, as a Minor he is compelled to attend school. as such he is thus compelled to interact with her as she is his teacher. He is not a free agent. Once he is 18, his agency allows him to continue in his interaction or not at his choice. Until then, as he is compelled to interact with her and she wields authority over him, any inappropriate interactions are considered entirely due to her abusing that authority. With legal adulthood comes responsibilities and one of those responsibilities is to abide by the laws of the community at large. It is assumed by virtue of her adulthood and her position that she is both capable of understanding those laws as well as discharging her duty as a figure of authority. The onus is on her to act appropriately.

What I said was there is a line between legal adulthood and being a minor unable to consent. Obviously there are instance where a person under the age of "adulthood" is able to give consent, but even in those instances, there are specific caveats that grant extra protections to the minor. This is a case in point where a person under 18 may normally have the ability to consent to sex except in cases where the other party is in a direct position of power or authority over him such as being a teacher.

not really entrapment, you SHOULD ask for an ID when you're not exactly sure of their age or if they're lying.
Let me give you a different example. If you were at a gas station, smoking a cigarette and some person bummed a cigarette from you and when you asked "Are you 18?" and they say "yeah". That does not bar you from being prosecuted for giving a cigarette to a minor if that person lied about their age. Or if you're at a bar that doesn't mark people's hands if they're underage and some girl you're chatting up asks you to get her a beer and she says "yeah, i turned 21 yesterday". That does not take away from your responsibilities. That girl could be 18 trolling you for beer. And if the cops asked and you said "well, she said she was old enough!" That wouldn't hold up.
Apply the age limits and this whole "well, he lied. Not my fault" idea to any other age-specific law, and you'd be laughed at.
In the end, what if the guy was 16? What about 15? Would that make a difference? And what if he still said, "Yeah, I'm 18, just turned last week"? What about the other way around?

Establishing a precident exclusive to men isnt what we should be doing. We're already the ones who get shit in the reverse situation. This precident would just imbalance things even more. The liar should be the one to face punishment in both cases, but just because we start charging men for lying doesnt mean we'll charge women for it. There is too much sexism in court for that to happen. If we manage to convict a lying female minor, then the court will be more likely to fall in line for both genders. Though men will still likely get the harsher sentence...

There's many who have been sent for a long time for 13-15 year olds, but 17 is not something that generally earns prison time. In most of the world, including most of the United States, it's completely legal to have sex with a 17 year old.
I don't think anyone should be sent to prison for consensual sex period btw. If you have sex with someone under 16 then you deserve some sort of punishment, but certainly not prison time. I'm thinking more like mental health counseling and community service.

Utah resident here. Totally ass-backward state, conservatism and traditional gender roles reign supreme, thanks to the good old Mormon church. A lot of MRAs complain that some women act like children; the LDS church makes that one of their primary focuses (speaking from experience as a female ex-mormon). Women literally have zero agency, they're just precious little angels who are pressured to marry as young as they possibly can to keep them as ignorant and naive as the day they were born. While men are to be the rulers of the household, the breadwinners, and therefore the most culpable for really, anything. Because of this mentality, criminal courtrooms are particularly lenient toward women, and family court is especially hard on men. It's an utterly unpleasant state to be in, and I laugh at anyone who thinks traditional gender roles are a solution to the bias against men.

State of the victim is taken into consideration when making these rulings. I'm guessing the women got her sentence suspended and is on probation because the kid she had sex with likely testified in her favor (e.g. that he wanted it and that there was no abuse of power). Hopefully she was fired at least (I would be very surprised if she wasn't).
Girls are more likely to take the victim route and testify heavily against their offender which is going to land the offender somewhere in the deeper end of the possible sentence.
I think this is men and women's rights issue actually. Girls take the victim route more often because if they don't they're typically shamed for sex while guys are rewarded for it.
This is bad because girls who aren't victims are encouraged to act like them while guys who ARE victims are encouraged to NOT act like one.
Anyway just think this is one of those cases where this is an overall a gender inequality issue on both sides and not just a men's rights issue.
I wish people would realize that a lot of the men's rights issues like this have roots as women's rights issues (if they aren't direct repercussions) and vice versa. Too often I see people here (and in feminist groups) really "taking sides" when are problems our one in the same.

Sounds like the judge is purposely opening the door to the possibility of an appeal to the Ninth Circuit or SCOTUS. It would be interesting to see either court determine the constitutionality of disparate sentences based on gender. There would be no other rational reason for a judge to go on record to voice their reason to discriminate under the color of authority.
Tl;dr: He's appears to be on our side, inviting legal precedent to stop this sort of gender discrimination in the criminal sentencing context.

Here in sweden, the age of consent is 15. There are greyzones for circumstances were the age difference isn't a lot and one of the kids is under age. The system works well and thus noone is thrown into prison for having sex with someone who is old enough to understand what sex is and prefers an older partner.

I have a bias that guys like to stick his dick into anything once he isn't a kid anymore. If they're 14+ they're no longer innocent to me. I think a lot of people share that bias with me.
There are cases where a babysitter rapes a kid, goes to jail, has his baby, and gets child support. Awful isn't it?
It's just not ok to do either thing. The law has to change, people's perspective has to change, even children would need some type of class or talk before they go to churches/babysitters/school/etc. I think that even if a guy is 14 and older (perhaps 20), he still won't know how to stop it/how to react to it/how to avoid it if he/she feels it's unwanted.
I think that it's good that we're at least getting things like this some press because I am sure it's happened before but the victims were silenced. Another thing, guy's and girl's brains need time (which we supposedly hit at 25 or older) so one day it will be the norm to give the "talk" about this "taboo" subject.

Ok, I'll throw my 2c in for 2 reasons.
When I was male I joined the NAVY at age 17. Shortly after 17 I was in bootcamp and then to A & C School. I was out of bootcamp before age 18, many months before. We were allowed to drink on base at age 18 at that time, but shortly after I turned 18 it changed.
So, legally, with my parents permission, I joined the military and was able to kill a person, not drink and not get married and not vote. But sex never came up because it was a given I was a "Adult".
Here where I settled a friends younger sister dropped out of high school at 16 and tried to finish on her own. She started secretly dating a 30 year old but nobody in the small town told the police. She ended up marrying the guy recently. She is now 18 and he is 33.
While I agree with it not being right, I hope someone can see where I am coming from on these feelings. There is a double standard on this issue but its slowly becoming less and less after a person reaches age 17.

What I meant was, the actual age of consent in the country where this happened is not so relevant to this as a Men's Rights issue, as the law is presumably equal in that respect (i.e. the age of consent is the same for women and men). The Men's Rights issue is the judge's preferential treatment because the offender was female.

In many states the age of consent is 16. I live in GA and the age of consent is 16 here. I think 16 is the most reasonable line to draw. Putting a twenty something man or woman in prison for giving consensual oral sex to a 17year old is absolutely absurd.
