Yeah, but that's a trust, not a bank. Mr. Hakimi here was essentially depositing all his income to his mom, the way I deposit my income (or my job does) to my bank, and then he would ask his mom to buy him something with his money, akin to how I use a card to let the bank know I want to use our money. A trust is set up with a purpose, one which could have existed before you got married, so I can see how someone there could argue that the money was not obtained during the relationship, but was instead already given, but simply distributed in recurring payments. Also, you could probably argue that the money in the fund is more like a gift or inheritance, which tend to fall outside of marital property (at least where I am). Add on the purpose of the trust being specifically for his benefit, then you could have another argument that the parents intended only the son to enjoy the money, because they could have easily stated it was from him and his family or something. Regardless, the joke I made was because HarithBK made me realize that Mr. Hakimi was essentially having his mom act as a bank, but the instance you mention is pretty different. But, hey, at least we'll know what argument Batman could use with all his trust and inheritance money.

He did it for two reasons:

His parents toiled for decades working blue collar jobs to give Hakimi a chance at making it big in football. Getting into pro-football is a long, expensive journey, and with little chance of success, so his parents literally gambled their lives on him. So this is his way of showing gratitude to his parents.
His parents are foreign nationals, so that money is technically a foreign remittance in a foreign national's name. Not sure how the clubs are managing to do it - justify these multi-million payments to an old Moroccan lady on their books - but once they do it, Hakimis don't have to pay / pay lower taxes on that money. So, it saves taxes.

Apparently, he was doing this since his first paycheck so the woman here wasn't able to demonstrate concealment of wealth for the purpose of defeating a divorce claim.

You're also likely giving a wrong answer though. Let's start with this fundamental truth: EVERY JURISDICTION HAS IT'S OWN RULES and I don't know where they live. That being said, several places would treat the transfer from husband to one of husband's family members, regardless of method of transfer and, in some circumstances, regardless of whether it is disguised as being for value received, as being a fraudulent transfer. If the court does so, then they can attribute the value of all those transfered funds in ordering a greater division of the funds he does directly hold still or even directly claw back the funds that the mother holds. This is not significantly different from the scenario where husband sells his truck to his buddy for a dollar to hide it in divorce proceedings. If the lawyers can trace it, the courts in many places will consider it in the division of assets.

Because my opinion is equal crimes deserve equal punishments regardless of gender. This context is important because it’s what impacts my opinions on everything else.

In general….When woman cheat and ask for their share I think that is also fucked up. Because the victim is the one that has to deal with the emotional stress and all the other bullshit that comes with a cheating spouse.

In this case it goes a step further. I know it’s very possible the sex was consensual. Still a cheater and the wife deserves the kid so there is some compensation for emotional damages and future child support to take into account. Hakimi is a soccer player so if he does get convicted his future earning potential plummets dramatically. Which means he wouldn’t be able to afford supporting his children. So if she goes for half of his current assets and forgoes any alimony or child payments, then whether he gets convicted or not is no longer a risk to her.

My opinion when it comes to gender, it should be equal crimes demands and deserves equal punishments. Therefore, my general opinion is one that will always support the victim. I don't know where you're from, but you absolutely DON'T combine assets and make them jointly owned when marrying. Each asset remains in their individual name and you share the value they gain during the marriage. If the asset didn't exist before the marriage then you share the whole value.

From the tweet, "Footballer Achraf Hakimi's wife filed for divorce and demanded half of his property". If that's not an exaggeration or mistake, then she's asking for property she doesn't own. Not even jointly.

Furthermore, articles have had to retract statements that he has been charged with rape because it's still under investigation but you treat it like a foregone conclusion. The fact that she flipped on him before any investigation could conclude tells me that either he's shitty in private, OR she was looking for any excuse to leap straight into a divorce. Her aggressive demands make it seem more likely to be the latter, but we'll have to see what comes out of the investigation.

The more i hear about these fabled couples, the more i find out it's either very religious people who fear the wrath of god (or worse, the wrath and loss of respect of fellow fervent religious peers) or people who have been married for years, hate each other, but can't be bothered to hit the dating market again, in their overwhelming majority.

But even so, let's say there's two choices. You're either with a ticking time bomb, or you're with an ideal partner. If you're with a bomb, marriage will ruin your life 10-30 years from now. You'll get divorced, you'll lose your house, your assets, your kids most likely and be ridiculed by society. If you're with your ideal partner, marriage (or lack thereof) won't affect your relationship. If they love you more than anything and you're one of the rare very compatible people for them, marriage should be no contingency.

So it's up to you whether the tax break and the fact that your will and medical intervention decision powers are done all at the same time and not separately are worth the exposure. To me, it seems like an obvious answer.

As someone who was once married this is my advice

1) don't do it. You don't have to be married to be together and only with each other. A wedding also isn't about you. It's about her mother and your mother. Trust me on this. Also the amount you spend will always be more than you expected to. Save your money and go on a badass vacation with your SO. You'll talk about that more than your wedding day

2) if you get married and have decided to divorce. GET A LAWYER! me and my ex who were best friends and would remain friends after we divorced and promised not to get a lawyer because it would be 50/50.... fuck all that. She took all the savings out of our joint account, got a lawyer, and I got nothing. And this isn't a dont trust women thing. This is a warning to you about your SO. You think it's all great until it's time to split. Then all bets are off. Don't be like me and trust the other person to do the right thing. Get a lawyer. If your a guy, get a female layer, they go after women more aggressively in the divorce. Yes I was dumb to trust another person and not listen to my instincts.

3) marriage is really not worth it. Do you like their family? No? Well too bad because you're going to be spending a lot of time with them. Have an opinion about them? Keep it to yourself. Your spouse doesn't care if you don't like her friends or family and will stick up for them at each turn no matter how much they get burned by their friends and family. Your life is also over. Hanging out with the guys? Nope. You'll either be called/texted every 15 minutes to come home or be accused of whatever her family or friends put into her head

4) all of my advice is based on my personal experience. It's not common yet if this shocks you and saves you from marrying a gaslighting sociopathic narcissistic white trash cunt, then my work here is done

Absolutely agree with this statement. I don’t understand why any sports athlete making millions of dollars, traveling from city to city, with a horde of beautiful women throwing themselves at them on a nightly basis, why any of them would want to get married? They have so much more to lose than the average person when a divorce comes up. If they really want to get married, there is no reason why they can’t wait until after the career ends when they are not making serious money anymore and see if their partner really sticks around.

In the United States about 48% of marriages end in divorce. And I would reckon to say that the remaining 52% that are still married, probably half of that are not happy in their marriage. They stick it out and stay together because they can’t financially afford to live on their own or they have kids they are trying to stay together for. So if you break it down only 25 to 30% are truly happy in their marriage. The divorce rate has come down, but that’s because partly less people are getting married .

Let me put it this way . If I were to sell you this car and tell you that there is a 50% chance that the airbags will not deploy in an accident and you can get hurt. Would you buy that car? I’m pretty sure almost everybody would say no. But you ask them if half the marriages fail and end in a divorce. Would you still get married ? 100% of the people that get married go through with it knowing that almost 1/2 will probably fail.

not really? i mean... not sure about this case specifically since the wording makes it seem it wasn't on intent of hiding assets despite functionally working like it and courts are really keen on the intent.

if a person did it it could be considered hiding assets get charged contempt of court and possibly with fraud , and still lose either way because the courts can still order for those assets to be given back or alternatively in cases such as being sold , get more of other assets or the court could order that person a maintenance order (monthly payments) higher that it would otherwise be.

there's not really an answer set in stone to give.

but one thing is true though , if you're found hiding assets from the divorce proceedings you have a good chance of pissing off the person with the most power over the ruling , the judge , and pissing off a judge is never a good thing.

yeah but not really , prenups aren't really magical contracts to be taken by the letter , divorce proceedings for the most part wish for neither part coming at a loss and if the court finds the conditions too unfair for one side then they can just toss it out for the most part to make a new agreement in court while keeping some parts of the prenup.

think like your own parents (wich im assuming are the standard issued Man working female housewife)

Your mother in the partnership sacrifices her financial independence in favor of depending of her husband , taking the responsabilities of a housewife.

the courts will see that your mother will really need help if she wanted to keep the same standard of living she had , as she won't have the work experience in the workforce that the other party possesses and she didn't get as she sacrificed that in the partnership.

and considering that they will probably assume that she will need more than the husband to achieve financial stability for whichever reason , and during the divorce proceedings the prenup will be voided because it doesn't give fair treatment to both parties.

that doesn't really apply if both parties are at similar levels though so that's there to think about if you ever get married.

It is pathetic that people believe a woman should be able to take half of a man's wealth for anything; if she wants a divorce, then that is fine - but she should not receive a fucking dime or even a ball of lint unless it is for child support.

In regard to the allegations, there are entirely too many that are false. When women are cognizant of the power advantage they have over men in our society through the court of public opinion and the legal system, do you honestly think that none of them would abuse it? Words should mean nothing unless they are proven.

The best thing that any men can do is keep to himself, for all it takes is a false accusation from a spiteful wretch or a divorce case from a parasite to ruin our lives; this civilization is fundamentally broken - rigged and morally destitute.

I despise this species greatly and resent it for what it has wrought upon the world and those who merely want to live the good life.

My attitude is a product of realism and adherence to truth; however, while I may subscribe to this objectivism, I do not relish the emotions that are born from it and cannot fault any individual for not feeling this way.

There is a part of me that wishes I could have remained ignorant to the many harsh realities of life; if that were not in the cards, it would've been preferable to be amoral enough to muster the will necessary to bury my head in the sand. Nevertheless, these what-ifs ultimately amount to nothing; the only thing left to do is cope and slowly but surely become numb to it.

I would like to make it clear that I strive to ensure that my misanthropy does not seep into my impressions of individual people; while I may have no love for this species as a collective, I know that goodness, intelligence, and wisdom are not myths even though individuals who embody these traits seem to be getting rarer and rarer as time passes.

I truly appreciate the kind sentiments as well as the reminder that all is not lost yet; perhaps, we can still turn everything around and create a better world for ourselves and the future generations.

If you are not happy and at peace, I hope that changes for you ASAP; it is a pity that pleasant interactions like this are not the norm.

You and your ilk are laughably predictable; whenever a person offers a point of view that does not align with your own, name-calling commences and the labels begin to fly.

Even if the one has cheated and this is proven in the divorce proceedings, they should not have to surrender a dime, nickel, or even a fucking ball of lint if it is not child support - that anybody can loose half their belongings to anybody, especially alone an accusatory golddigger, is revolting.

In regard to the rape accusations, they are meaningless unless backed by evidence; that the motto "believe all women" has taken the place of "innocent until proven guilty" is a travesty.
