Actually the death penalty used to be an option in rape cases prior to Coker v. Georgia, 433 U.S. 584 where it was ruled that the death penalty for the rape of an adult was grossly disproportionate. Prior to 2008, when the supreme court ruled that the death penalty was disproportionate for any case not involving a death, the death penalty could still be applied for the rape of a child.

If askfeminists was a real sub dedicated to answering tough questions and not simply banning everyone who isn't already a feminist, I would ask them this:

Why do feminists constantly portray rape as several degrees worse than murder? Why is murder A-ok in video games, but games involving some allusion to rape, even if treated tastefully, some massive offensive crime? Why do they constantly ask for rape punishments to be equal or greater than murder punishments? Rape is terrible, I agree, but it doesn't make sense to treat it as worse than murder.

I tried asking this once to a feminist who I actually respected at the time. Queue "you just wouldn't understand" and "it just is worse, trust me." I responded that if I had a daughter, then god forbid, I would rather she get raped than murdered because she would still be alive and could still possibly live a good life. But of course, "I wouldn't understand." But if you can't articulate WHY something is worse than murder, then why do you think society should collectively just lap up your unjustifiable opinion and convert to punishing all rape with insta-death penalty?

As a woman, I will gladly admit that the feminist movement is a bit out of control when it comes to these kind of things. Ever since rape and sexual assault of any sort became more publicized on television (ex.: every fucking Oprah and Dr. Phil episode ever) these things became more open to discussion, and the way it's handled now is a little outrageous. It's pretty much a proven fact that ALL men are sex crazed, and female are superior to that. Now, don't misunderstand me on that. There ARE men out there who are ABSOLUTE FUCKING SCUM, and deserve to gassed, but what about the number of women sexual assaults? My aunt works for the department of corrections in our state, and she tells me about the number of cases of women she's seen where WOMEN are sexual assaulting children, and selling their daughters for sex to get money. The sad fact is that she says she gets more beastality cases with men. From all that rant I think my main point is especially from the comments before is that EVERYONE is different and that if you're going to put the death sentence for rape remember that you're not only killing men, but also scumbag women where they probably won't die for a long time because in most states they'll just sit on death row and patiently await their fate....unless they live in Texas.

If the punishment for rape is worse than that of murder, then what is stopping your rape from turning into a murder? If you're raped you are a witness and can testify; you can't testify as a witness to your own murder. The death penalty for rape will give the rapist incentive to murder you, eliminating the most important witness. What a dump arse.

Everyone is mentioning how murder rates will rise if a rape conviction results in the death penalty. I think that's fairly extreme, but that may be the case with rape where the victim doesn't know the attacker, but what about acquaintance or date rapes? How many cases would go unreported because of social pressure or guilt?

Considering that male rapists tend to be a small percentage of repeat offenders compared to a large number of female occasional offenders, maybe feminists should get what they want here (provided of course that all forms of legitimate rape are recognised and due process exists).

Not only would far more women fall prey to a death sentence for rape than men, but the move would backfire for feminists so badly that women would desert feminism faster than the women in 1st class deserted the sinking Titanic.

It's a serious crime. Men AND WOMEN should be subject to stiff penalties for rape. Rape laws can change to reflect the serious nature of the crime and false accusers should face years in prison.

I'm all for Mens' Rights. I truly am. But I feel like sometimes this sub is trigger happy from time to time. As for this particular post: 1) There's nothing here that particularly discriminates against Men. She may be a feminist, but we do not know the extent of her feminism. She could be an extremist (and I see why that assumption, given the content of the sign). 1a) Her sign doesn't explicitly say anything about Men being rapists. While that is more statistically likely, a few of my close female friends have been raped by women. Her sign could simply be a wake up call for the uniting of like-minded women. 2) I think that as Mens' Rights activists, we should also support the rights of women. That being said, we should take both rape and the accusations of rape extremely seriously. Therefore, we should not simply dismiss anybody speaking out against rape.

In conclusion, I think rape accusations still take precedent over serial accusers. I fully acknowledge the implications of false accusations, but I think that we can all be united against rape.

We should work to have rape victims more comfortable and secure when coming out. We should also work to shame and discourage false accusers.
