This is the reason that EVERYONE with at least $100K in assets should have a Revocable Living Trust that transitions to Irrevocable Trusts for the Beneficiaries (inheritors). Common language in these trusts is that the only possible people that can become Beneficiaries are descendants. Wifey no get inheritance.

When your son (or daughter - it works either way) gets divorced, his wife's lawyer will not be able to touch the trust assets (oh, you still might be on the hook for alimony or child support, but no the trust assets).

In Georgia, inheritance is typically separate property.... but there are exceptions. If any of that money got commingled (like the accidental transfer to the joint account), her lawyer can argue it became marital property. That's what they're doing.

The fact you kept it in a separate account under only your name for years works in your favor, but that one transfer is the crack they're trying to wedge open. Your lawyer should be fighting this hard.... showing the transfer was accidental, minimal, and didn't change the character of the inheritance. If they're not, they're either being lazy or don't know how to counter it.

You need to push your lawyer. Ask them directly: "What's your strategy to protect this inheritance? What case law supports keeping it separate despite the accidental transfer?" If they can't give you a clear answer, consider getting a second opinion from another attorney.... even just a consultation to see if your current one is leaving money on the table.

Don't assume this is already lost. But don't sit quiet either. Document the account history, the source of the funds, and the isolated nature of that transfer. Make your lawyer do their job.

Inheritances are not a marital asset. I had a similar situation with my divorce with a large sum inheritance from my father who passed away during the marriage. In my state, inheritances are not marital assets, unless you comingle the funds into a joint account marital account. You need to find a lawyer that fights for you and knows the law.

What was this disclosed as during filing? Bigger question, why was this disclosed? The biggest mistakes are made right during the filing. If this was disclosed as a separate asset or not disclosed, its worth a fight. However if you disclosed as part of marital property it boils down to how you negotiate and what you tell the judge when it comes to trial.

Inheritance is normally exempt unless you co-mingled it to make it commutal money. The divorce is already finalized unless it was withheld during discovery it doesn't matter. It doesn't matter what the eX or her attorney say. By definition they're going to just lie to you and hope that you cough up money.

You need to talk to a local attorney or your previous attorney to confirm things. In the end she won't get the money, but this is going to cost you more time and money to defend.

In my state (MO) inheritance is one of the few things protected, as long as it isn't co-mingled. The interest deposited into a joint account would be co-mingled, but only the interest would be considered marital assets.

Inheritance is separate property in GA, but commingling (like that accidental transfer) can complicate things. Your lawyer should be fighting harder on this. You need aggressive representation, consider getting a second opinion from other attorneys who handle such cases in GA (stevenson firm, marble law, ailyons attorneys etc). When you were divorcing, did you go through the discovery process where you shared all financial assets and liabilities with opposing counsel? If so, was this inheritance shared during discovery?
