I’d like to see the actual Canadian Court case and statutes on common law marriages in whatever province this was in.

Many US states have some sort of situation. In my state, the couple has to be living together and hold themselves out to the public as husband and wife. It’s more intense than having your girlfriend of six months who is living with you telling her friends that she is married.

Both Canada and the United States are based on English common law, so there is probably more to this story.

It's stupid shit like this why I stay single. My ex gets nearly 35% of my wage before taxes and she earns twice as much as I do. And I still have my kids half the week. Pay half of clothing, pocket money and holidays as extra. This is CSA in the UK. So I have to cover her half of custody as well as my own. In Portugal we have the same law but you need to live together for 3 uninterrupted years which seems much more sensible...

Still the couple doesn't enjoy all the same protections of a married couple and I'm 99% sure this excludes asset split and alimony (thank god)!

It has some tax benefits, extra visitation rights in hospitals and stuff like that. I'm not very sure about those small things on the law so I don't want to talk out of my ass...

Canadian here. I broke up with a guy after we had lived together for a few years. We had bought a condo together, so I needed a formal "separation agreement" to make it easier to take my name off the title and have him buy me out of my half. A friend of a friend was a divorce lawyer so I went to her for help in getting the paperwork together. She strongly advised me to sue him for everything he was worth "because I deserved a lot more". I backed out of there hastily, with separation agreement in hand, and kept everything amicable. But she was really eager to do so much more... shudder

I know someone else who had lived with his girlfriend, with her earning substantially less, and he had bought the house all himself. When she left him she had a lawyer force the sale of his house and she got half. It took him a long time before he'd even look at another woman again.

This only happens if you voluntarily claim it on your tax return (both people). Otherwise the government is unaware, and/or does not consider it a common law relationship.

I was curious what the general feminist consensus on the issue is. A quick Google search ("canada common law marriage feminism") doesn't really seem to give much actually related to the issue, but what it does yield on the first couple pages is all in support.

I would have thought there would be at least some debate over whether something like this is feminist due to the fact that the woman doesn't consent to it, but I suppose I shouldn't be surprised that it gets a pass.

This also applies in Scotland. It was what got my "half the current value of used belongings" when I had to move me and my son out of the flat I shared with my cheating partner. I spent way more money on absolutely every piece of furniture in the place than the half I got back, but it was enough to pay deposit and first month's rent on our new place. I had to borrow money from my dad to furnish our home.

This shouldn't be seen as something that's only for women, it's also for men. It doesn't give people more powers over someone else, it protects people like me who were in terrible relationships and being denied everything when promises of being civil and fair were made verbally. You'll find as soon as solicitors and money are involved, how vindictive people can be. And this stops people taking the piss.
