In my city there was a mother who was worried about her children, she and some of the children's teachers placed calls with the CPS, but they were told they had to wait until after they got their court date to contest the custody agreement. The dad killed the two children before the hearing. Imagine the horrifying desperation of this mom who tried to fight the system, but the system wouldn't let her keep her children safe.

This is one of the major reasons why I got an abortion. My ex had been a gangbanger and a drug dealer with a criminal record outlining his penchant for violence. He'd done jail time, claimed to have murdered two people (one in a stabbing and another in a drive-by, neither of which were ever connected to him), had killed animals, and told me he'd beat all his past girlfriends. He raped me, reproductively coerced me, emotionally tormented me, and threatened to kill me if I ever got an abortion.

Even if I could prove everything he'd done, he still wouldn't have had access to his child denied. It isn't until a man has already traumatized their child, with copious evidence, that the courts might revoke access. You're powerless to do anything until your child has already been abused and scarred for life. And my ex was obsessed with having kids. He wouldn't have done me the courtesy of being an absent father, he and his fucked up family would have petitioned for custody.

This is one of the many hallmarks of a patriarchy, that children are considered the property of their fathers and that it is legally and ethically impermissible to deny a man his property. You could get one of the world's most renowned experts to testify that a man has all the predictive indicators that he'll abuse his child if given custody and it wouldn't matter in court.

I've read a few books on custody and family court while I was in it and it is true that parental alienation is a highly contested subject, primarily used by male judges, and many advocate groups have been calling it out for decades. Its a made up term with no evidentiary support, there is no one in psychology who will agree that it's real. Yet these old male judges keep trotting it out to defend men from what are often accurate accusations.

The dad almost let his daughter drown in his pool while in his custody; Rutherford was admonished by the judge for not coparenting because she took a family photo including the dad (who she was divorcing at the time) off the wall of her living room.

The court system in the west doesn’t exist for women. It doesn’t punish r@~e. It doesn’t protect our children. It doesn’t work for any of the crimes that women face. When I was much younger and dumber, I used to work for a psychologist who would be an expert witness in court, custody stuff mainly. I remember there was a parental alienation case where the young teenaged daughter claimed her dad was sexually abusing her. The psychologist declared she was lying because, based on her descriptions, her father didn’t “follow the pattern” of pedophile sexual abusers. He said this in private to me with a strange mixture of contempt and dismissal. Now, I’m not a psychologist, but it sounded like BS to me. Dude also called the women he tried to court on OLD “dinner whores.” I’ve been surrounded by right-wing men my whole life, so it was strange hearing such misogynistic garbage coming from a proudly self proclaimed progressive democrat. In Australia, this stems from the fact that the child’s ‘right to have a relationship with both parents’ is given the SAME CONSIDERATION as the ‘child’s safety’. Women get shanked in court all the fucking time because we don't trust ourselves, don't keep evidence, and when we stay to get ourselves in a good place to leave, we get accused of "staying with him" instead of running away. If someone's abusing you, sometimes you need to plan and squirrel away money. Most people can't just pick up and go. And even if you do pick up and go, where's the evidence? When someone's abusing you, you don't think "save this text, send screenshots to friends", you think "I'm absolutely embarrassed this is happening, I don't want to tell anyone, I just want out of here".

So I'd really really love to know why she couldn't produce those messages in court. Most judges in the US are men. We still make up ONLY 20% of politicians. The laws aren't in our favor.
