Reread your initial issues. You need to be very careful. Don't practice in MA, and don't know the rules. Likely you committed at least assault 2 (or something similar) which would be compounded by it being domestic. The statute of limitations on most violent crimes is often VERY long (3-5 years). If she's documented when and what happened, it doesn't mean you're in a safe zone from prosecution. The big thing you got going in your favor is that it was a one time deal and provoked.

Massachusetts has some of the oldest, archaic laws out there. Family law there is going to not be favorable, and anything that looks bad to the judge is only going to make things worse. I understand the give and take, but in the eyes of the court you're a violent abuser, so adding an emotionally abusive threat of destroying family heirlooms... Just want to very strongly caution you from similar behavior from here on out. Don't think she's not keeping track of everything and having it ready for the court.

Sorry to hear about what you and your soon-to-be-ex are going through. I don't mean to stand on a soapbox/highhorse in the following comment, but I wanted to share my thoughts.

It's really unfortunate that you hit her (for both of you). I have hit someone before, and have seen how it completely takes away one's power. Aside from the physical and emotional pain that she suffered from being hit, it was, strategically, almost the best thing that could have happened to her. I think you should contact a lawyer and ask him/her for advice on any future interactions with your wife. It seems like she's not above conniving, dishonest tactics for revenge, so anything you do now has a good chance of becoming fodder for your possible arrest and divorce battle.

While the legality of this may be questionable, you may consider writing your car title over (or selling for $100) to a trusted friend. Neither you nor your wife own it, then, so there's no fighting over its value. Your friend then decides that he doesn't want it anymore after you are fully divorced, and you buy it from him.

Good luck. Make sure to take a mechanical approach to the rest of your divorce. No emotions when it comes to getting through it. Just get your shit done and move on... and never become bitter about her, or else she'll always hold power over you (and you'll just be a dick).

I'm glad you got your car back, and sorry for what you're going through, but just be careful the way you go about it. Your phone records, including texts and pictures are discoverable, so your "fire with fire" approach is fair game for the courts.

Also, if you inherited the car, then it is YOUR non-marital property, and your wife had zero rights to it...meaning you should have called the police and reported it. That way, you would have gotten the car back and smell a lot rosier in court when you guys finally get there.

If she pulls anything else, call your lawyer and the cops...don't sink to her level.

When I worked at a pawn brokers I was told not to take items from people if I believed it was from their significant other. This was because the significant other could go to the police and report the item as stolen and it would be returned to them.

In effect the pawn broker would be out the cash and the item.

Also I think the person who put in the item could then be charged over it.

I moved countries for the girl, got a decent job, and when she decided that it wasn't enough, she slept with 84 different people (no joke, I have this number confirmed by various sources) including a former best friend. I found out about it, damn near put her (and him) through a wall and would have if I didn't come out of my little blackout, and what did I get for my trouble?

Colorado Springs found in her favour during the divorce settlement; she got EVERYTHING, based on her lawyer arguing that I wasn't fulfilling the role of a husband or her physical needs, and that I was abusive.

I'll tell you something for free; if I ever see that lawyer, I'm going to finish on him what I started on her - between that motherfucker and my bitch of an ex wife, they ruined me.

I'm glad you're getting some dues - keeping giving as good as you get.

Ok so your response to the entire situation is to keep up the eye for an eye method when dealing with this situation.

Step 1: She cheats on you retaliation: You hit her and claim you were emotionally abused because she tore into you for not sexually satisfying her.

Step 2: In retaliation for you hitting her, she goes below the belt and attacks something you love, just like you attacked her. Retaliation: You do the exact same fucking thing by taking her brooch.

Step 3: She charges the towing of the car to you. Retaliation: you hock her brooch at a pawn shop in order to get pay for the towing and to get back at her for charging you for the towing.

Conclusion: You are both petty little children, and this divorce is probably the best thing that could happen to the both of you. You are both incapable of having a mature adult relationship, and need to grow the fuck up.

Also, you should have never laid a hand on her. You abused her, and that is NOT cool no matter what the fucking excuse is especially if she did not lay a hand on you physically. Breakup 101: You cut things off cleanly and do NOT contact the other party except through a lawyer. This is why you are dealing with the shit you are going through now, because you decided to get into a petty shit-slinging fight. Grow the fuck up, and make sure the only contact you have with her from here on out is through a lawyer.
