This especially bothers me, I'm in college and have had to deal with numerous posters and my dorm having several meetings about how you need a clear concise yes to a properly worded question. That is not UK law. The following is from the Sexual Offences (Scotland) Act, which mirrors the provisions for England and Wales.

If a person (“A”), with A's penis—
(a)without another person (“B”) consenting, and
(b)without any reasonable belief that B consents,
penetrates to any extent...

That's the definition for Rape. Note the part about reasonable belief. Now what constitutes a reasonable belief is a grey area. A point lost by most people on both sides of the debate, but most frequently by the "feminist" (for lack of a better collective noun) side.

The question is this: when a rape case often comes down to "he said/she said" would it be permissible to say that the defendant had a reasonable belief as to the accuser's consent and such belief was informed by the fact she was wearing sexually provocative clothing. In addition to other factors. Is that permissible? Where is the line drawn?

Turns out rape and other sexual offences involving consent are a lot more complex than most people give credit for, and the particular circumstances of the particular case are often highly influential.

You can't just leave the description of rape as an offense with SOA 2003 s1(1)(a-c), especially where consent is the issue at hand. S1(2) states, as it does in the first four offenses in the statute

Whether a belief is reasonable is to be determined having regard to all the circumstances, including any steps A has taken to ascertain whether B consents.

The CPS guidelines for sexual offenses state, convieniently concielcly, that the test for reasonable belief can be sum missed as such:

Did the defendant believe the complainant consented? This relates to his or her personal capacity to evaluate consent (the subjective element of the test).

If so, did the defendant reasonably believe it? It will be for the jury to decide if his or her belief was reasonable (the objective element).

So in regards to your comments about the complainants clothing and whether that would be permissible as a basis for reasonable belief, the answer is pretty clearly no.

Furthermore, consent isn't actually that unclear in English law. Yes, the circumstances in each case are important, but that's the case for most violent offenses. There's a fairly well fleshed out body of precedent defining these issues, and the word "consent" is itself very clearly defined in s74 of the 2003 act.

I believe its been that way for a while but they were reaffirmed by the sexual offences act 2003, and I believe forced sex with a man is covered by a select area under "causing sexual activities with out consent" which allows for a life sentence (only 3 other areas have life anything else off the top of my head has a maximum of 5 years)

Edit: For anything else - summary offence 6 months indictable offences 10 years

Edit2: Whilst I dislike this system, men are at least covered by something... I just hate the "same but different" crap, thankfully uk law is based on consistency and I don't think judges would separate the 2 issues but its possible

As this poster is from the UK, our law specifically states that consent cannot be present where:

(the complainant does not have) the capacity (i.e. the age and understanding) to make a choice about whether or not to take part in the sexual activity at the time in question.

The question, elucidated in R v Bree off the top of my head, is whether the complainant was sufficiently intoxicated as to impair their ability to choose to have sex. Therein lies the difficulty where both parties are drunk, however where it's only the victim that is impaired the onus is 100% on the defendant to obtain reasonably believable consent.

The law in the UK has a section that allows the defendant to say "I reasonably believed she consented" basically if they are acting as if they are a reasonable person and the reasonable man would think they were capable of consent then that's a defence, the mere intake of alcohol doesn't prevent consent, the inability to consent from large quantities of alcohol is but that is generally visible to the reasonable man. There is no point where you "get approval" for sex. In terms of "approval", sex is like having a very personal talk with someone. You don't say "yes, I want to talk to you".

Not to mention all they need is circumstantial evidence which if you did have sex etc... There will be an abundance off, added to interviews etc. Its entirely possible to be convicted without concrete evidence... These aren't "rapes in alleyways" they're false accusations with someone consenting or seeming to consent... There will be plenty of circumstantial evidence I mean they can get motive, opportunity and so on. Due to th current climate surrounding these crimes the police/CPS are hesitant not to take then forward due to fears of being called incompetent.

Heads up, I'm a feminist. I agree that the primary issue I saw with the poster is the lack of diversity in victims, perpetrators, and relationships. I will definitely take your word for it that it must come off as patronizing and almost offensive, for the poster to imply that the normal guy can't distinguish what a woman wants or not. While I don't think the majority of guys have that issue, I think that too many guys aren't able to accurately distinguish. I'd blame it on porn, rom-coms, and all other media that promotes this whole "no means yes" and "playing hard to get" thing women are supposed to do in order to not look slutty or easy.

I also think it's primarily adolescent guys who misunderstand a woman's desire for lack thereof and vice versa. That's why the campaign to re-frame conversations about consent and sexual encounters is aimed at college campuses-- where tons of people are having their first chances to engage in sex and are not seasoned and don't have insight.

It's not to absolve women of responsibility in communication. In changing the sexual landscape to one where more people care about their partner's desire, pleasure, and well-being instead of one where sex is viewed as a transaction, we hope women will be empowered to say no, and also that they should have no reasons to fear saying no (like rejected people reacting aggressively), nor reasons to fear saying yes (such as slut-shaming).

I have no inherent problem with the message the poster is putting out, that consent in important, not to the level of certain people in the thread I don't believe that we'll have slips of paper that need to be filled in. My primary problem is that it doesn't show any real examples that apply only to men. I would just like to ensure that you're clarifying that you believe that adolescent males and females have difficulty with the concept of sexual consent, as your wording was a little vague in that respect. Is this what you are establishing?

If so, I agree. College kids in general don't know a thing about what they want. Someone made the mistake of letting college students think they're adults, so the idea of a rulebook kinda goes out the window, unnecessarily. Campus life lacks many of the boundaries that would keep normal people from getting themselves in situations that could wind them in trouble (regardless of how you'd like to define 'trouble').

I think one of the first things colleges need to do is abolish the idea of a college as a social institution. It's a place of learning.

There is no implicit consent when the party is unconscious unless they have a established a rapport where waking up to sexual contact is accepted within the relationship. This too can be established implicitly, when neither party rejects it when it's done. That's a pretty common thing so we shouldn't dismiss it. That said if a person was unconscious and no rapport has been established then there'd be cause to fear the lack of consent.

FYI: The best "rape" prevention method found in studies is educating women to say "NO" to contact they don't want. I put rape in quotes for a reason, since it's better described as preventing unwanted sexual contact in most cases since the "victims" would not describe these experiences as rape.

Most people think that if a woman gives every sign that she is a willing participant and never speaks up in opposition then the sex is consensual. Sex without consent is rape but sex without stated consent is not automatically rape. Implicit consent is apart of our everyday life in civil society. For example if a napkin dispenser or toilet is within a restaurant it's presumed customers can make use of those facilities without special permission. In the same way two lovers sharing a bed make touch one another without first requesting explicit consent every time they do so. If we asked what they'd prefer it wouldn't be what this poster suggests, a situation where parties who have established a rapport live in constant fear of sexually assaulting one another due to the impractical standards set by over zealous activists.

The theoretical framing you present in which a short skirt would equal consent bears no resemblance to our lived reality. Short skirts are common, rape due to those factors is not. To base policy on preventing rape on a obscure or nonexistent attitude wastes precious resources and creates needless anxiety in women who are foolish enough to take radical activists seriously. Communication within the sexual context is very much a personal matter, the red line is established by rejecting advances in a overt manner, to imply that needn't be done is to live in denial about healthy and normal sexual interaction. Completely transparent. They've taken two items and put them together in an attempt to keep men from having sex with women:

First, they know most people generally do not make verbal agreements prior to intercourse. They simply do it.

Second, they understand that a man asking a woman's permission to have sex is a huge turn off to them, and will most likely end in a refusal.

When you put these together you get men who won't pursue sex out of fear of rejection, and women who won't allow it out of pure irritation. Problem solved; that is if you really believe all sex is rape, all men rapists, and all women are rape victims like feminists do.

I don't understand why they feel the need to go overboard with this. To start with, we already have laws concerning consent. They aren't rape laws, they're just general consent laws.

If you don't feel you can say no (and a reasonable person would agree) then that's not consent. If you lack the mental faculties, temporarily or otherwise, to understand what you're agreeing to, that's not consent. If you are physically unable to signal disagreement, that's not consent.

These rules apply to police questioning, entering into a contract and, of course, agreeing to have sex with someone.

The last point is the worst. Unless the mentioned factors are in play, an absence of a no can be considered consent. A potentially violent partner, being significantly intoxicated, being unconscious - all factors that can cause apparent consent to be considered invalid.

Personally, I think these kinds of posters need to focus on communicating what is and isn't consent to both parties and encourage people to be aware of mitigating factors. At the same time, the idea that only explicit verbal consent counts can easily confuse people. Given how intimate most sex is, communicating refusal can be easy, so it's only really the cases where one party wants to refuse (or would want to if they were aware), that need to be addressed.

I think it's a shame that some women feel too scared or pressured to say anything even if they didn't want to have sex at the time, but that doesn't make it rape and a poster like this isn't going to help.

I also think women should stop playing coy in the bedroom because they don't want to seem like sluts, and should be taught to be more forward with their desires. That would help more than this poster will.

Settle down. Male rape is if anything a more important issue to address as I saw at least three comments on the original post, from both men and women suggesting that male rape did not exist. I agree overall with the message of seeking consent but honestly I think there are bigger issues surrounding rape, particularly as some people seem to be of the opinion male-rape does not exist.

This is a mens rights sub, of course all of us want to avoid raping anyone, and anyone else raping anyone. and any education the Police want to put out about that should overall be welcomed. But only if it is shared equally between genders. There's no use teaching people about consent if some don't even believe men can be raped.

I put it up as a nod to the fact that there was nothing male-rape oriented in there. I'm by no means saying that education about sexual boundries is not a good thing, I just feel that we have had so much education as a society, both here in the UK and in the US, geared towards female-rape that maybe it is about time that we stopped seeing posters like this and started seeing ones with, yes, some of the points on this one as well as points that educate that male rape is a thing and is just as bad as rape of a female.

You should probably lead with that in future. If you've got a message, make it clear and simple, like the image you posted. I'm with you on the education and awareness front, 100%, especially because us men are encouraged to be sexually active and thus declining unwanted female attention is seldom discussed and in some cases, actively discouraged, but talking about other issues clouds what we both seem to hope to achieve. Whether a girl says yes or no during sex doesn't matter. All that matters is how she feels about it the next day, and how the people around her her feel about it.

So if her roommate, best friend or mom throws a shit fit about it the next day, it really doesn't matter what the girl said to you, or how willing she seemed. She can't control the forces of society around her, which will come rushing past her with the momentum of a freight train.

So it's just as important to look out for the freight trains of influence behind the girl, because very often, she's not the one who's opinion you need to worry about.
