Even though I think Brian is dead, there's a couple of important points

He is still not charged with her murder. they charged him with some bullshit financial crime. Which means they're grasping at straws. They found nothing good during autopsy; and the case right now is entirely circumstantial.
Prosecutors have to prove that he killed her "beyond a reasonable doubt". The bodycam footage of cops thinking about charging her for domestic provides more than reasonable doubt.
Their only place to go is try to catch him in his lies or get him to confess. If he stays silent or presents self-defense case, good chance he'd walk away from this, a la Casey Anthony.

Which brings me to my final point: Do not talk to police if you want to stay out of jail. Sometimes preponderance of evidence will make that impossible, but in cases like this investigators are in real trouble if you don't give them anything.
