I would advise against it for several reasons.

17 year olds have a tendency to go bat shit crazy after a while, they are not emotionally mature enough to fully grasp the implications of being FWB.
If her parents find out it may besmirch your image in your community.
Sooner or later it will end and you will wish that she didn't live in your building.

Even if the age of consent is 16, there are often other restrictions. For instance, in PA where I live, the age of consent is 16, but there's a "4-year rule", which means that if they're under 18, it's still statutory if you are more than 4 years older than them (so a 17 year old could only go up to 21)

So I was quite nervous about this but after doing a little research online, I found that the age of consent in my state is 16, not 18 as I thought.

This is a handy reference for age of consent in the US. Many people aren't aware that the age of consent is not 18 everywhere. It varies state-to-state and the most common is 16.

That said, I wouldn't do it. I've been with younger girls who were just above my state's age of consent. In my experience, they're just not as emotionally mature as women who are a bit older. After the last one, I decided to not go for girls who are much under 21. Why? Because there are other factors to consider:

A) You're 26. If you like to drink on occasion, you cannot do it with the girl at all. If you're even just having a drink or two and she has one, you can get in trouble for aiding and abetting a minor. Of course all of this really depends on you getting found out.

B) Friends with benefits often turns into more because when you're sexually involved, it's easy to develop emotions for someone. Especially when you're younger. If you're not okay with either having a 17 year old girlfriend or hurting her feelings, cut it off now.

C) Having to sneak around is no fun. And if the parents find out, be prepared for MAJOR drama. It may not be illegal, but try reasoning with a protective parent.

D) Even though it's legal, there's a HUGE fucking stigma to dating someone who's under 18 when you're nearly 10 years older than them. Even with the 5 year age gap I was dealing with, some people looked at me like I was a fucking creep (even though I was actually dating the girl and her mom approved because she could see I wasn't just looking for young pussy).

E) The fact that you're asking tells me that you're very uncertain about it. Don't go for something that risky unless you're damn sure you can deal with the risks.

Just my 2 cents as someone who's been in similar situations. If you still want to go for it, go for it.

Florida has a law that says the age a of consent is 16, but if a person under 18 has sex with someone over age 23, the 23+ year old is committing a felony. I think several other states have similar laws. Good luck if that is the case.

I am assuming that you also checked to make sure there were no "age gap" clauses in your state. For example, in my state that age of consent is 16 but it can still be considered statutory rape if the other person is 36 moths or older than the 16 - 18 year old. Example: If an 18-year old boy had sex with a 16 year old girl, it's legal. 19 is okay as long as the three year spread is not broken. 20 and up - go directly to jail, do not pas go and register as a sex offender for the rest of your natural life. At 18, there are no restrictions. If you really want to CYA, you don't do a damn thing until she turns 18 and then introduce her to the many wonders of the Kama Sutra.
