Paternity fraud is like any other fraud, it has emotional, mental and financial implications and thus should be treated similar to other fraud cases.

The sentence should be proportional to the time of the fraud, a grace period of 6 months should be given. After 6 months, a woman should be sentenced two times the amount of fraud so if fraud is detected after 8 months, she should get 16 months of jail etc.

The prosecution should only have to prove that the defrauded person is not the biological father. The defense should have burden of proof about intent etc

So if a woman is raped, she needs to prove that she was raped. If the baby was swapped at hospital, it's for the woman to prove with dna that she is also not the mother, if she honestly believed that he was the father, she needs to show that she took enough steps to ensure it and still made an honest mistake.

I derive the argument of reverse burden of proof from the following.

Duty of Care: A doctor or any medical professional can't just say that they didn't intend to give the wrong medicine or treatment or that they made an honest mistake, they need to show that they took proper steps to ensure that they gave the right treatment and still made a mistake.

Not having intend to harm is not enough. Since women have so much power over the fate of men and children, they have the duty to ensure that they have done everything to identify the correct father.

Statuary Rape: The prosecution has to only prove that illigal act happened. They don't need to prove intent. The burden is on the accused to show that. So if the accuser actually forced the accused to have sex, or whatever argument defense wants to show, the burden is on the defense, not prosecution.

Same should be the case for paternity fraud. A woman has lots of power and she should not abuse that power or treat that power lightly, Responsibility is on the woman to take all the precautions to not misidentify the father.

Proportionality of sentence and Grace Period: 6 months grace period is enough for woman to come clean. Proportionality of sentence means that the longer she keeps the roose, the longer she will serve time.

Criminal Liability: Jail time is essential to right the wrongs, simple monetary compensation is not enough. You can't take away precious years of a man's life, use his resources and time on another man's child and then pay some money and be done with it.

Deterrence should not be the goal, punishment should be the goal. A man who is disgruntled may decide to take law in his own hand, it's better a woman serves jail time. She pays her debt to the victim and the society and the victim can move on with his life knowing that justice happened.

If this is implemented, Women may decide that it's too risky to not have DNA tests at birth by then so they may push for it. That would only make them hypocritical since when it comes to their own protection, they would certainly be all for DNA tests. But that's not surprising.
