No where I am aware requires legally requires your wife's consent. It is your body you can do what you want with it and it is demeaning for them to ask you to get her permission. She can get an abortion without your permission or even knowledge, I'd challenge them on it.

This issue has come up before in other areas and has been clarified very quickly. If they don't acquiesce I'd ask a lawyer what the law is in your area. If they are right about the law or refuse service then the MRM has a campaign for your area. There is no way in hell I'd let them push me around on this one.

I'm more interested in how this is legal from a HIPAA perspective. It's pretty clear she doesn't have a right to know, so how is the doctor's office requiring her consent fall within the guidelines?

Case in point, courts have ruled minors can get an abortion without parental consent or even knowing about the child's medical situation. Why should getting a vasectomy be any different?

Vasectomies aren't 100% and if the woman gets pregnant, they want to know that she can't sue them because you've, e.g. misinformed her.

If I were you I would ask them to send you all paperwork saying they need to get your wifes permission. Then tell them you're going to forward the information to the ACLU.

This is clearly a violation of your rights.

This type of prior restraint was clearly a violation of a woman's rights when they needed to get their husband's permission for birth control.

The reverse is also true.

I think it's fair for them to suggest that you have a conversation with your wife first but to REQUIRE it is wrong. You are NOT property of your wife.

This topic has been brought up many many times here before. It is a terrible policy, but there is no law regarding wife's consent for vasectomy. Individual offices make their own policies, and while they may be out of good intentions or protecting themselves from legal issues, they are really misguided and there are plenty of doctors who would never think of asking for your wife's consent.

I would start by telling your doctor why you are offended by his policy. If he still insists on getting your wife's consent then I would look for another doctor and start by asking each office about their policies. Honestly I think some doctors do not even know why the "wifey's permission" is offensive, but until we start speaking up nothing will change. I had never heard of such policy until I started reading Reddit. My doctor never even asked about my wife.

There is a common-law tort called loss of consortium which is designed to compensate for deprivation of familial relationships. In practice it almost always refers to sex. There's probably some reading of the law that would make a vasectomy tortious in the context of marriage, but it would have to apply equally to something like tubal ligation to be consistent. I guess if the doctor messed it up there could be a suit if there were permanent damage, and while his malpractice insurance would cover your damages it wouldn't cover hers. In the modern context that seems really silly to me, but I suppose there would be precedent supporting it. Presumably the waiver is designed to avert such a suit.

As for HIPAA or anything like that, I don't know of any federal law which would make it illegal to deny this service for failure to produce the waiver, since it doesn't directly disclose Protected Health Information. The legislature could immunize doctors who perform vasectomies from loss of consortium suits, but I doubt there'd be much interest in such a thing.

It could have been a general surgery consent form. For example, if something goes wrong with the surgery and you're in a comma. This is how they determine who makes the choices on your behalf.

Now I know with this kind of surgery that isn't practical. But they usually have general release forms.

You're allowed to get snipped without permission for anyone but yourself. There is no law that i am able to find that determines anyone else has control over your body besides you. Just the same for females getting abortions or tubes tied (not sure what the cynical name for that is off hand. )

My husband was told he needed my consent. We later decided to have my tubes tied(for non-related reasons), no one ever mentioned me getting his consent. So biased!

It would be really pathetic if HIPAA had loopholes that allowed a doctor to say, "I will not perform this procedure unless you give up your federally mandated privacy protections and let me share your medical information with whomever the hell I want." It sounds really fishy to me, as in, it might actually put them in breach of the law rather than protecting them from it. Your wife can't sue your doctor because she didn't agree to a procedure that you elected to have.

I would have a serious conversation with that doctor about HIPAA, doctor patient confidentiality, and generally respecting his patients privacy.

Requiring an adult to divulge medical information to someone else, anyone else, before they'll provide care is pretty outrageous... No less suggesting that you need PERMISSION from someone else. Sounds like a slam dunk privacy lawsuit to me.

It's pretty fucked up, but do take the case of someone that is medicated or otherwise in some altered mental state. It makes sense for the surgeon to cover his ass, he should maybe have asked for a consult from your GP or a psychologist or something.

Is it a consent form or a statement acknowledging that she's aware you're doing it? For example, here in Canada when one gets a firearms license the application requires any current or ex spouse to sign stating that they're aware you're buying a gun, but their consent isn't required.

This happened to my brother in law. The insisted his wife come in and approve it. When I had mine done I actually had my wife write a letter saying she was okay with it just in case they bawked.

All that said...they never asked and I'm snipped as of about three weeks ago.

It mattered less to me than the difficulty of finding another respectable urologist closer to my home.

If you care that much, forge her signature. They won't call you on it but if they do then it'll be in the legal system and the policy will actually get changed.

The problem in this case is not your doc, but your judicial system and the dumbfucks that try to make money out of it.

If you're not ok with this, just go and look for another doc. Though, if you don't have any problem with your SO, it's really not worth any other efforts.

There is absolutely no legal requirement that would require a wife to give permission. It is his body, and if he wants a vasectomy, he can get one without telling or asking his wife beforehand.

That being said, you need your wife to give permission. If you don't, she won't be your wife for much longer. ;)

Just because it's not required, that doesn't mean it's a good idea. Only an idiot would get this done without a lengthy discussion with her beforehand.

This is not at all a men's rights issue. Some asshole sued some surgeon somewhere and ruined his life after he performed a vasectomy, this doctor heard about it, and isn't willing to risk having the same happen to him.

The problem here is that anybody can and will sue anybody else for any reason.
