This is an ethical minefield for doctors.

A good friend of mine comes from a medical family and his brother works at a major hospital in the US and is responsible for genetic testing.

Say you have your blood taken and tested and then you go and see the consultant who gives you your results?

That's what he does.

Anyway, I'm told that mistaken paternity is far, far more common than you would think but for ethical reasons doctors will not disclose this to their patients. The best they can do is to tell them that "Yes, there is a 100% certainty that your child will not inherit this genetic disorder that you are both dominant for".

Most people are pretty overjoyed that their child is healthy, whereas some of the more savvy ones will start to wonder how their child could have not been born with a condition that they were both genetically destined to pass on to their offspring...

Curious thing is it would remove any problems over paternity claims. The father would be known instead of paying an agency to pursue the man the woman says is the father, and possibly having that man dispute. This leaves no ambiguity about who should pay. I suspect the truth is that a woman will claim the father is the man most able to pay, and that suits the state's purposes too. I also believe paternity testing should be passed into law.

The reason is because that most women, and some men, when faced with these options:

Paternity fraud continues to exist. Paternity fraud is a significant problem because there is potential for serious consequences to the father, child, and cuckold. The child can face medical (physical) consequences, such as hereditary diseases, or lack of match for transplants or other donations.

And of course there is usually significant psychological harm to the child and cuckold, and sometimes to the actual father if he didn't know.

We implement mandatory paternity testing, ending paternity fraud, but acknowledge that some women do lie and commit paternity fraud (and also there is minor financial cost).

Most women would prefer option 1, since they can never be harmed by it. And there are some deluded men as well who prefer option 1, who think women would never lie.

If we had infallible lie detector tests, and required men (and women) to assert that they had no desire to have sex with children, and obviously never actually had sex with children, before taking on childcare occupations, would you support such a law? All it takes is a minor financial cost to implement it.

Would you trust men or women who did oppose such a law?

If you want to give the policy its most generous explanation, it's because it's in the best interests of the child.

If the test comes back that the putative father is the actual father, nothing changes.

If it comes back that the putative father is not the actual father, there's a good chance the putative father will not stay in the picture. The actual father is more likely to be a worse provider/role model/etc than the putative father would have been, and it's possible he won't be located at all, leaving the child with no father.

Like others said, this would save everyone time and money. Down the road if there is custody and CS issues, the court doesn't have to deal with the ATM... i mean "father" trying to prove via DNA testing that he isn't the father. They know who to bill from the get-go.

In many ways, it is a matter of informed consent with regards to signing the child's birth certificate. Most fathers sign it without thinking, without being made clear of the fact that by signing it they could be saying "I hereby claim responsibility for this child who I don't know is my child. I also give up in many states all avenues of recourse should I have been deceived."

The fathers need to know that it IS their child before they are able to consent to signing that document. Of course they can physically sign it, but in my opinion, it isn't informed consent then, making it worthless

Not necessary. All we need is a system where false paternal identification is an absolute defense against child support. That's not going to happen.

The state has almost no interest in legislating the private sexual conduct of its citizens.
The state isn't going to leave money on the table by having numerous unidentified fathers not on the hook for child support when there's a perfectly good husband or boyfriend they can go after.

I never trusted my ex-wife (with good reason). However, if I had gotten paternity testing when my son was born, I would at least have known that he was mine at that time, and my later relationship with my ex might have been somewhat better. (I didn't really start doubting until the divorce, at which point it was too late under my state's laws to do anything about it.) My take on the issue is that MRAs should launch an informational campaign to make early paternity testing normal and to try to get it covered by insurance. And to change the law if you live in a state that doesn't allow paternity testing (within a reasonable period of time) to bar claims for child support.

I watched a pretty good friend agonize for 9 months over his then GFs pregnancy. We were in our early twenties and none of us were ready for children. I could tell he was very nervous about it because he was drinking VERY heavily, like not the fun kind of drinking heavily, the scary kind.

Well, the baby arrives and it looks nothing like him. Did a test and it wasn't his.

If patriarchy^tm were true there would be mandatory paternity tests as it is definitely in the best interest of men, and against the best interest of woman. Since almost noone, And certainly noone in power, has ever seriously considered it, the notion of patriarchy^tm becomes difficult to defend.

As to why it hasn't been made into law, I suspect it has to do with the expense, and the risk of violence against the women who are about to force someone to raise another man's child.

They tried this in the UK in the 90's but found a staggeringly high percentage of duped fathers and stopped the procedure doe to all the trouble that it caused.

IMO it would make the birth certificate more of a legal document than a wall poster if the information on it was scientifically verified.

I agree they should be mandatory. Forget about issues of custody and child support for a minute - the fact is that one of the best assets you can have in giving a child the best shot in life possible, is a complete family medical history.

The fact is that with so many wrongly identified fathers out there and so many unknown fathers out there, one of the big dangers out there for kids are hidden illnesses and conditions which may complicate surgeries and procedures which might be needed down the track.

Paternity tests at birth would eliminate that.

I am a woman and I support this idea.

My brother dodged a bullet a few years ago when his ex got pregnant and she tried to make him believe it was his. It belonged to a man she had a short fling with right after they broke up, and then she tried to get back together with my brother when things went sour between her and her fling. He didn't even know she was pregnant until a few weeks after the breakup when he heard it from a mutual friend of theirs. She and her fling had the baby, and then got married shortly after it was born. She was also kind of a psycho and was one of those girls that had a "timeline" she wanted to follow or else she thought of herself as a loser. If my brother had gone back to her, I could only hope he would be smart enough to ask for a paternity test when the kid was born. Luckily she admitted to the fling and saved him some trouble!

And my brother lived happily kid-free ever after. :)

I think a reasonable compromise is that the paternity test only be undertaken in matters before a court. In court, paternity should never be assumed. In my state, the state already requires testing for 30+ medical conditions, genetic typing for both the parents wouldn't be that hard.

Another solution based on the honor system, with teeth.

This would have been wonderful for me when my first child was born. It would have saved me years of being called a slut, whore, and liar. Unfortunately, it would have required an act of God to get that loser within 100 miles of the hospital when the child was born. That's the biggest problem with such a scenario.

Due to the cost, I never did get the paternity test done. I didn't need it to know the truth, and I didn't care if that loser never showed his face again.

It would put a large unneeded burden on the medical system. Medical students, and doctors are taught to not order tests that are not necessary. Someone has to foot the full bill for these tests, and there would be hundreds of thousands of them done every year, which would be quite expensive. That's why there is the option for parents to get one, but it should not ever be mandatory.

I suppose if I'm going to play devils advocate here, many people are likely happier not knowing. There must be guys out there happy with their partner and kid, in a situation where knowing the truth would just suck for everybody involved mostly the kid. I know its important biologically, but I like to think so some extent we evolved past it. I do kind of hate those TV chat show scenarios where a guys been raising a kid, only to discover their not the father and so disappear. The way I see it its about burdens of proof, if no-one is doubting paternity (ie married couple with trust) then the husband is accepting to be the father, if the named father contests though then the way I see it the mother is making a claim about the responsibility and the burden should be on her. Therefor she should pay for a paternity test if the named father contests. It shouldn't be the burden of a named father to prove themselves not to be the father if named. You also have to remember people will resist laws, the couple could well throw away the unopened results out as an expression of trust, you can't really force people to get the test, in addition to this it isn't that cheap. Of course if the mother names the father, he agrees and it turns out its not his due to a later test then its clearly fraud on her part.

Let me explain why you will find tremendous amount of opposition from lots of people, including moderates, to this idea. It is in the best interest of the child to be brought up in a two-parent family. This is the gist of it. We don't know how much it happens, but we do know that women who cheat on their husbands is a large number. If you force a paternity test at the moment of birth, there will be a lot of damage to a family, where the other way around, the father would have been none-the-wiser. There are millions of fathers today who are bringing up children who they assume are their own, and they'll probably die not knowing the truth. This is unfair to the fathers--there's no doubt about it. However, by mandating paternity tests, an otherwise intact family might lead to breakup of the parents, and end up hurting the child in the long run. REMEMBER: The courts will look out for what they think is the best interest of the child, sometimes even going over the rights of fathers. (Case in point: fathers who realize they are not the biological parent, but are still required to pay child support).

I'm Canadian, but something like this would have been a huge help to me. I almost went a whole year with my (now ex-) girlfriends child that all through her pregnancy I was pushing to have aborted, because I quite strongly believed that neither of us were ready to have a child together (we were early twenties, still figuring shit out and going to school), or a child at all.

Thing is, she and her family pretty much dominated the child after she was born, and my family got upset that they never got to see their niece/granddaughter. Once my girlfriend left me, my family got more aggressive, demanding visitation/etc, only for girlfriend to reveal that it was not my child. I had been suspicious during her pregnancy as the dates didn't match up to our encounters and we weren't taking massive risks that might have resulted in her becoming pregnant, but it was still possible so I figured it was just 'bad luck' on my part and accepted it.

there is a lot of logic going for the idea of 100% paternity testing. There's a growing movement for home births that don't take place in front of a doctor or in a hospital setting. So what happens then, does a woman produce a newborn and demand a birth certificate? How do we know it's hers and not a baby stolen from someone else?

I work with newborn children and this would never fly. Not because of feminism or anything else, but because everything of this nature requires permission from the parents. Parents even have the choice on if their children receive their newborn vaccinations or not, let alone a test to see who the father is and vaccinations are more important in the context of 'what's best for child'. I've been parents refuse to put an IV into their child (which was overridden since it was life saving, but still).

Apologies if this has been said already, but one reason would be that it is unlawful to force dna testing. One thing we should he against as a society is letting the government create a dna database of us all. Also, once you in the system, could you imagine if any of those drunk one night stands where you never even kept in contact with a girl resulted in you having to pay child support because the found you through the system? Ok, maybe not you, maybe its some rock star who has sex with a different girl in every city. Maybe you were using a condom that broke, or she put a pinhole in. Who knows. But once your in the dna database, you could be tied to pregnancy from any girl you had sex with throughout your whole life.

I think this would give women too much power. Why? Because while it does happen that women are mistaken or full out lie about paternity every once in a while, the fact is, a man is always the father and through a dna database, he will always be found, always be held responsible.

I think every man should have the right to request one and shouldn't be shamed for it, but having a formal system in place to collect mens dna so that they are held accountable for a pregnancy? No way.

Imagine a particularly grotesque rape had taken place and there's abnormally much semen all over everywhere. So you fit her description and they just look and say "this one got big balls, it could all fit in those" and they haul your ass to jail without doing any dna testing.

In any other kind of situation proper investigation would be done.

Soon it's probably going to be handled the same too. With cops going "just admit you're the father, sign the paper and you'll get the plea bargain deal of 19 years of child support instead of 25" or some absurd bullshit like that.

MensRights seems to misunderstand paternity according to law. DNA testing is ONE way to prove or disprove paternity.

The law is weighted towards finding of paternity for spouses of the mother under the theory that it helps maintain stable family units. If the spouse of the birth mother signs the birth certificate (meaning he accepts paternity) then he is legally the father in most states. There is almost no means in most states for another person to challenge paternity of the father in this case. Even if the man and his wife were separated and she was clearly living with someone else. This is because the law favors spouses and marriage, and the law disfavors what it sees as adultery.

The law also favors claims of paternity. If an unmarried male claims paternity, and the mother agrees, then he usually becomes the legal father of the child. This is because the law favors claims of paternity.

DNA testing is still something that courts struggle with. Because in many cases it introduces an element with which courts are uncomfortable. Courts want spouses or claiming fathers to be able to be fathers because this generally (not always) tends to reduce the number of fatherless children. DNA tests can show that people who did not want to be fathers are IN FACT the actual conceptual father. This creates situations where third parties are introduced into family law proceedings that no one wants in those proceedings. You then have 1)The spouse or claiming father, 2) The mother, and 3) The biological father. This makes already messy family law messier.

Automatic paternity tests would benefit some men, but it may also make it harder for kids to actually have a real relationship with their father. The principals of family law may be outdated and in need of reform, but there are real consequences to changing them.

You have to understand why the marriage blood test was started. I think it was because people were related but didn't know it and the risk of double recessive defects increased. So it actually prevented some inbreeding. Testing after birth doesn't prevent anything health related. I think its still a good idea to get tested, but you don't need a law or even a doctor to do it. There are several companies out there that will do it for a price. I like 23andme. The dad and the kid just spit into tubes and you send them off. This one gives you more than just relation information. You can know what genetic diseases you have and what you are at risk for. It can decloud the mystery of life a little, as in maybe you don't want to know you will have health problems in the future, but help prevent some things by being prepared.

Who's going to pay for it? If it's mandatory by state law, then the state should foot the bill. The other problem I see is that, if the DNA doesn't match the father, what then? If the purpose of this test is to establish paternity and the guy who came in with the woman isn't the father, what then? How do they track down the man who really did father the child?

IMO it should be voluntary, the sort of thing that a father can ask for privately when his girlfriend/wife has given birth, and I think it should be done behind the mother's back without her knowledge. Fathers ought to have that right. It has to be done discreetly though, because if the woman hasn't cheated at all and finds out that her partner thinks she has (thinks it to the extent that he'd go so far as to paternity test the baby), that's going to ruin the relationship. I mean, for crying out loud, I was annoyed that they put antibiotics in babies' eyes here in Ontario as a matter of course, just in case the mom has the clap so that the baby won't go blind. WTF is up with that? They can do a vaginal swab and test you for that, and then they'd know whether or not they even need to put goo in baby's eyes. I found it a little degrading to have it assumed that maybe I had an STD. At least they no longer use silver nitrate...that crap is bad for your eyes. Still though, I didn't appreciate the implications. A paternity test would be even more insulting...I've been nothing but faithful to my husband since we started dating. I don't need a test to prove that these children are his. Lucky for us, they looked enough like him right at birth that it was pretty obvious whose they are. But I can see a lot of women getting their backs up about being the implication that they might be cheating hos who are trying to foist a love child onto an unsuspecting man. That's why it should be discreetly made available to the father, without needing the mother's consent or awareness.
