Here's a good rule: If you wouldn't make a particular facial expression with your own face to a colleague/boss/subordinate, you probably shouldn't use the corresponding emoticon in text communication either. It's an emoticon, yes, but it carries with it a connotation.

The winking emoticon is generally understood to have a flirtatious connotation with it. Maybe the fifty year old guy doesn't realize that, but as an internet savvy 24 year old who communicates frequently via email for work, I would never use a winking emoticon in professional communication.

TL;DR: Not sexual harassment, but not professional, either.

A certain few old guys wink at all the time and they don't do it to flirt. They do it to (jokingly) imply that they are up to something. To secretly say "I'm on your side." Personally I always thought they were the coolest people I'd ever met.

While I would suggest that this woman is likely overreacting to something not intended to be sexual, what exactly is so ridiculous about the idea that adding a winking emoticon can add a sexual tone to a message? That's pretty much the main connotation of that emoticon among younger people online, in my experience. I pretty much never use the emoticon except to add sexual tone, and I would never use it in a professional communication for exactly that reason.

Just finished a mandatory sexual harassment training, I'll weigh in. It's not about the perpetrator's intent. It has solely to do with how the victim perceived the incident. So if she felt that there was unwanted sexual advances she could notify a supervisor and he could be given a warning. Most of the time if this was a first time thing he would just be given a warning; however if he was a repeat offender he could get transferred or fired.

TL;DR It has more to do with what the victim perceived than the intent of the accused.
